Public Meeting – February 25, 2014 The Township Council of the Township of West Orange met in the Council Chambers, 66 Main Street, West Orange, New Jersey at 7:35 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 22, 2013. Roll Call: Present: Councilman Cirilo, Councilman Guarino, Councilman Krakoviak, Councilwoman Spango and Council President McCartney Absent: None Public Comment The Council President asked if there was anyone who wished to make a statement at this time. Lee Ann Zaolino, Mt. Pleasant Avenue, West Orange Robert Moss, Green Acres Mark Meyerowitz, 19 Howell Drive, West Orange Dahunsi Alabi, 593 Mt. Pleasant Avenue, West Orange Rosary Morelli, 22 Ralph Road, West Orange Christine Bosco, 4 Masson Place, West Orange Anthony Puglisi, Public Information Officer, Essex County Sue Freivald, 10 Ridgeview Avenue, West Orange There was no one else who wished to be heard and the public hearing was closed. Resolutions The following resolutions were adopted: Resolution #37-14 Resolution Authorizing a One (1) Year Extension of the Contract Between the Township of West Orange and Tax Serv for Private Collection of Municipal Court Debt 1
Resolution #38-14 Resolution Authorizing a Professional Services Contract to Herbst Musciano, Architecture and Planning, 611 Main Street, 2nd Floor, Boonton, NJ for Professional Architectural Services, Subcontracted Land Surveying and Professional Engineering Services Associated with Renovations at 549 Valley Road, West Orange, NJ Resolution #39-14 Resolution Authorizing a Refund of Duplicate Payment of First Quarter Taxes to Listed Taxpayer(s) Resolution #40-14 Resolution Authorizing the Collector of Taxes to Rebate Payment to the Listed Taxpayer Pursuant to Judgment by the Tax Court of New Jersey Resolution #41-14 Resolution Authorizing Issuance of Raffle Licenses Resolution #43-14 Resolution Authorizing Reimbursement Costs for Private Garbage Collection for the Period of January 1, 2013 through December 31, 2013 to Private Home Owner Ordinance on Second and Final Reading Ordinance #2400-14 On motion made by Councilman Krakoviak and seconded by Council President McCartney, AN ORDINANCE AMENDING CHAPTER 15, SECTION 15-7 TO UPDATE THE TOWNSHIP’S RENT CONTROL ORDINANCE, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. Following discussion and on motion made by Council President McCartney and seconded by Councilman Krakoviak, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”. 2
Ordinance on First Reading Ordinance #2400-14 AN ORDINANCE AMENDING THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE, CHAPTER 23, SECTION 1, ESTABLISHING FEES AND RATES AT GINNY DUENKEL POOL FOR THE 2014 SEASON, was introduced and passed on first reading. All members voting “Aye”. The Clerk read the ordinance by title only. Following discussion and on motion made by Council President McCartney and seconded by Councilman Krakoviak, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on March 11, 2014. All members voting “Aye”. Resolution #35-14 Resolution Authorizing an Agreement with Goose Control Technology for a Term of One Year to Provide Goose Egg Treatment at Three Sites for $2,500 and to Coordinate a Volunteer Nest Site Identification Program for a Flat Rate of $500 for a Total Contract Amount NTE $3,000 Following discussion, a motion was made by Councilman Krakoviak and seconded by Councilman Cirilo to modify the language of the resolution and contract with regard to payment for volunteers. After further discussion and an explanation by the assistant township attorney Ken Kayser, Councilman Krakoviak withdrew the motion. A motion was made by Council President McCartney and seconded by Councilman Guarino, the above mentioned resolution was adopted. Councilman Cirilo, Councilman Guarino, Councilwoman Spango and Council President McCartney voting “Aye”. Councilman Krakoviak voting “Nay”. Resolution #36-14 Resolution Re-appointing Jessica Glicker as the Township’s Communications Director/Public Information Officer for the Remainder of 2014 at a Rate of $3,300 Per Month Following discussion and on motion made by Council President McCartney and seconded by Councilwoman Spango, the above mentioned resolution was adopted. Councilman Cirilo, Councilman Guarino, Councilwoman Spango and Council President McCartney voting “Aye”. Councilman Krakoviak voting “Nay”. 3
Resolution #42-14 Resolution Authorizing Execution of Consultant Agreement between Township and Bashkoff Enterprises, LLC Following discussion and on motion made by Councilman Guarino and seconded by Councilman Cirilo, the above mentioned resolution was adopted. Councilman Cirilo, Councilman Guarino, Councilwoman Spango and Council President McCartney voting “Aye”. Councilman Krakoviak voting “Nay”. ABC HEARING A motion made by Councilwoman Spango and seconded by Councilman Cirilo to adjourn as Council and reconvene as the ABC Board, was carried. All members voting “Aye”. Resolution #512-14 – Place to Place Transfer, License No. 0722-33-042-003, Lincoln Highway Industrial Development, LLC (pocket license) to The Stone Depot Eats and Drinks, 437 Main Street, West Orange Following discussion and on motion made by Councilman Krakoviak and seconded by Councilman Cirilo, the above mentioned resolution was adopted. All members voting “Aye”. On motion made by Councilman Krakoviak and seconded by Councilman Guarino, the Council adjourned as the ABC Board and reconvened as the Council. All members voting “Aye”. On motion made by Councilman Krakoviak and seconded by Councilman Guarino, the above meeting was adjourned at 10:05 P.M. .
