1 Public Meeting – March 24, 2015 The Township Council of the Township of West Orange met in the Council Chambers, Municipal Building, 66 Main Street, West Orange, New Jersey at 7:35 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on December 4, 2014. Roll Call: Present: Councilman Cirilo, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango and Council President Guarino Absent: None The Township identified and presented for unanimous consent, Item 4 (Minutes), Item 5 (Report), Item 7 (Bills) and Item 8 (Certain Resolutions). On motion made by Councilwoman Spango and seconded by Councilman Cirilo, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time. Resolutions The following resolutions were adopted on Consent: Resolution #100-15 Resolution Extending the Deadline for Payment of Sewer Charges from April 1, 2015 to June 1, 2015 Resolution #103-15 Resolution Authorizing the Township of West Orange to Enter Into an Agreement with the National Ovarian Cancer Coalition (NOCC) to Participate in and Benefit From the Downtown Classic 5K Run Resolution #104-15 Resolution to Approve Tax Appeal Deduction from Calculation of Tax Collection Rate Resolution #106-15 Resolution Extending the Contract with D’Onofrio & Son, Inc., Landscaping, 47 Van Ness Terrace, Maplewood, NJ 07040 in the Amount of $135,000 for the Maintenance of Various Township Owned Parcels, Including Turf Maintenance, Litter and Debris Collection, Weed Control and Fall Leaf Collection and Disposal for a Third Year for the Period Beginning April 1, 2015 and Ending November 30, 2015 Resolution #107-15 Resolution Binding the Township of West Orange to Purchase Electric Generation Services Through the Essex County Aggregate Energy Procurement Cooperative Pricing System Bid Resolution #108-15 Resolution Authorizing the Collector of Taxes to Rebate Payment to the Listed Taxpayer Pursuant to Final Judgment by the Tax Court of New Jersey Resolution #109-15 Resolution of Continuing Support for the Goals and Purposes of the 2004 Highlands Water Protection and Planning Act Resolution #110-15 Resolution Authorizing the Issuance of Raffle Licenses Resolution #111-15 Resolution Authorizing Waiver of Garage Sale Fees for Project Graduation Fundraiser
3 Ordinances on Second and Final Reading Ordinance #2445-15 On motion made by Council President Guarino and seconded by Councilwoman Spango, AN ORDINANCE AMENDING AN ORDINANCE CREATING A RECLASSIFICATION AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE EMPLOYEES SETTING FORTH THEIR TITLES, CLASSIFICATION AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEE’S STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF PERSONNEL-ASST. SUPERVISOR/PUBLIC WORKS/CERTIFIED POOL OPERATOR-ASST. SUPERVISING MECHANIC-RECORDS SUPPORT TECH 1, SR. PUBLIC WORKS REPAIRER/PARKING METER COLLECTOR, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this was the scheduled time for the public hearing and asked if there was anyone who wished to make a statement at this time. There was no one who wished to be heard and the public hearing was closed. On motion made by Councilwoman Spango and seconded by Council President Guarino, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. Councilman Cirilo, Councilwoman Spango and Council President Guarino voting “Aye”. Councilman Krakoviak and Councilwoman McCartney voting “Nay”. Ordinance #2446-15 On motion made by Council President Guarino and seconded by Councilman Cirilo, AN ORDINANCE CREATING CHAPTER 2, SECTION 61 OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE ENTTITLED “PEDESTRIAN SAFETY ADVISORY BOARD”, was taken up on second and final reading. Councilman Cirilo, Councilwoman Spango, Councilwoman McCartney and Council President Guarino voting “Aye”. Councilman Krakoviak voting “Nay” The Council President stated that this was the scheduled time for the public hearing and asked if there was anyone who wished to make a statement at this time. There was no one who wished to be heard and the public hearing was closed. On motion made by Councilman Cirilo and seconded by Council President Guarino, the above mentioned ordinance was defeated. All members voting “Nay”. Ordinances on First Reading Ordinance #2447-15 CALENDAR YEAR 2015 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40 A:4-45.14), was introduced and passed on first reading. The Clerk read the ordinance by title only.
4 On motion made by Councilman Cirilo and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on April 14, 2015. All members voting “Aye”. Ordinance #2448-15 AN ORDINANCE CREATING CHAPTER 2, SECTION 61 OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE ENTITLED “PEDESTRIAN SAFETY ADVISORY BOARD” This Ordinance was not introduced on first reading. Resolution #101-15 Resolution Authorizing the Re-Appointment of SLEO Robert Stock as Class 1 Special Law Enforcement Officer Specifically the Parking Enforcement Officer for a Period of One Year (Police) On motion made by Councilman Guarino and seconded by Councilwoman Spango, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #102-15 Resolution Granting Limited Waiver of Obligation to Install Sidewalks on Extended Portions of Nance Road and Colonial Woods Drive On motion made by Councilwoman McCartney and seconded by Councilman Cirilo, the above mentioned resolution was tabled. All members voting “Aye” to table. Resolution #105-15 Resolution to Introduce the 2015 Municipal Budget On motion made by Councilwoman Spango and seconded by Councilman Cirilo, the above mentioned The Minutes of this meeting are on file in the Office of the Municipal Clerk.
