1 Conference Meeting – October 24, 2017 The Township Council of the Township of West Orange met in the Council Chambers, Municipal Building, 66 Main Street, West Orange, New Jersey at 6:40 p.m., Fatima Baez-Aguilar, Municipal Clerk’s Office Assistant read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975. The annual notice was emailed to the Star Ledger and filed in the Township Clerk’s office on November 28, 2016 and published in the West Orange Chronicle on December 8, 2016. Roll Call: Present: Councilwoman Casalino, Councilman Cirilo, Councilman Guarino, Councilwoman McCartney, Council President Krakoviak. The Council held a discussion of meeting dates for Calendar Year 2018. Mr. Sayers gave an update on the progress of Phase I of the Redevelopment Project on Main Street. DUPLICATE of Resolution 218-17 (10.3.17) c. 224-17 Resolution Authorizing an Emergency Appropriation Pursuant to NJSA 40A:4-48 to Fund Amounts Owing to Others for Taxes Levied and Further Authorizing the Issuance of Emergency Notes to Fund Such Emergency Appropriation (Gross) d. 225-17 Resolution Making Application to the Local Finance Board Pursuant to NJSA 40A:2-51 for its Review and Approval of a Refunding Bond Ordinance to Fund an Emergency Appropriation for Amounts Owed to Others for Taxes Levied (Gross) e. 227-17 Resolution Authorizing the Tax Assessor and Tax Collector to Cancel the Taxes Assessed on Block 137, Lot 11 (Vacant Land) for the years 2016 and 2017 (Dillon) In 2015, Block 137, Lot 11 was merged into Block 137, Lot 10 and for that year and subsequent years the taxes for Block 137, Lot 10 included the taxes from the prior lot 137/11. Block 137, Lot 11 remains on the books in the duplicate resulting in taxes being assessed for that lot. f. 228-17 Resolution Authorizing a Discharge of Mortgage for Property at 19 Calvin Terrace, West Orange, NJ, Block 148, Lot 67.01 (Planning) g. 229-17 Resolution Appointing Leonard R. Lepore and James Williams as the Township of West Orange Community Development Representatives to the Essex County Division of Housing and Community Development for the Year 2018 (Planning)
3 h. 230-17 Resolution Authorizing Inclusion in the Essex County Urban County Community Development Program for Program Years 2018-2020 (Planning) i. 231-17 Resolution Authorizing the Collector of Taxes to Rebate Payment to the Listed Taxpayer Pursuant to Final Judgment by the Tax Court of New Jersey (Gagliardo) j. 232-17 Resolution Authorizing the Tax Collector to Reimburse Taxes Due to an Overpayment (Assessor) On motion made by Councilman Guarino and seconded by Councilman Cirilo, the consent agenda was approved. All members present voting “Aye.” Resolution(s) Removed from Consent Agenda Resolution 226-17 Resolution to Award a Contract to Willdan Energy, 200 Middlesex Essex Turnpike, Suite 304, Iselin, NJ 08830 as the BPU Direct Install Contractor for Energy Efficient Measures for Various Township Facilities in the Amount of $65,545.27 (DeSantis) On motion made by Councilwoman McCartney and seconded by Councilman Guarino, the above- mentioned resolution was approved. All members present voting “Aye.” Ordinances on Second and Final Reading-None Ordinances on First Reading Ordinance 2529-17 On motion made by Councilman Cirilo and seconded by Councilwoman McCartney, Refunding Bond Ordinance Providing Funding for an Emergency Appropriation for Payment of Amounts Owing to Others for Taxes Levied in and by the Township of West Orange, in the County of Essex, New Jersey, Appropriating $3,200,000 Therefor and Authorizing the Issuance of $3,200,000 Bonds or Notes of the Township for Financing the Cost Thereof was approved on first reading, ordered advertised according to law, to come up for second and final reading on November 21, 2017. All members present voting “Aye.” Ordinance 2530-17 On motion made by Councilwoman McCartney and seconded by Councilwoman Casalino, An Ordinance Creating a Reclassification and Salary Schedule of Certain Township of West Orange Employees Setting Forth Their Titles, Classification and Salary Ranges and Adopting a Salary Guide and Establishing the Employee’s Status as a Township Employee and Under the Guidelines of the New Jersey Department of Personnel was approved on first reading, ordered advertised according to law, to come up for second and final reading on November 21, 2017. All members present voting “Aye.”
4 Ordinance 2531-17 On motion made by Councilwoman McCartney and seconded by Councilwoman Casalino, An Ordinance Authorizing Special Emergency Appropriation Pursuant to NJSA 40A:4053 for Severance Liabilities Resulting from Accrued Leave in Connection with the Layoff or Retirement of Employees was approved on first reading, ordered advertised according to law, to come up for second and final reading on November 21, 2017. All members present voting “Aye.” Pending Matters/New Matters/Council Discussion Councilwoman Casalino inquired about a personnel issue in the Property Maintenance department as well as the asphalt issue on Main Street. Mr. Sayers addressed both issues with the Council. ABC Hearing On Motion made by Councilman Guarino and Seconded by Councilwoman McCartney, the Council entered into the ABC Hearing All members present voting “Aye.” 589-17 Hearing on Renewal for Plenary Retail Consumption, Distribution and Club Licenses for the 2017-2018 License Term (Clerk) On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the above- mentioned resolution was approved. All members present voting “Aye.” At 9:32 p.m., on motion made by Councilman Cirilo and seconded by Councilwoman Casalino, the meeting was adjourned.
