Show all pagesVice Chairman Neuer said as a result of further discussion, the Board permitted Board Member Schwarzbaum to visit the site to determine if the bulbs protruded below the shields that were installed on the spot lights. Vice Chairman Neuer stated that it is the Board’s belief that this suggestion was erroneous and that the original condition did not relate to the configuration of the shields but only to whether the lights shined towards the neighbor’s house. Vice Chairman Neuer stated that although a resolution memorializing the results of ZB-18-05 at the July 19, 2018 Zoning Board meeting has not yet been adopted, he said that on that night this Board voted to deny the application without prejudice and that motion was passed. Vice Chairman Neuer recommended to the Board that no further action be taken on this application other than requesting that the Board Attorney prepare a resolution that reflects the denial of the application ZB-18-05 without prejudice. There was some discussion amongst the Board Members. Vice Chairman Neuer made a motion to deny without prejudice application ZB-18-05 requesting to have a condition removed from the original resolution of approval; Ms. Weiss seconded the motion. The vote was as follows: Eben: - Steinhart: Yes to deny Gabry: - Straker: - Phillips - Sussman: No to deny Quentzel: Yes to deny | Weiss: Yes to deny Schwarzbaum: No to deny | Vice Chairman Neuer: Yes to deny Vice Chairman Neuer stated that original resolution stands.
