Bogerman, PLS - Applicant’s Surveyor Our office is in receipt of a copy of a September 17, 2019 letter from Francis X. Regan, Esq. with Decotiis, FitzPatrick, Cole & Giblin, LLP of Teaneck, New Jersey to the West Orange Planning Board which requests a waiver from Section 25-13 of the Township Land Use Regulations requiring the submission of an Environmental Impact Statement (EIS) for the subject application. We have reviewed this waiver request and offer the following comments: 1. It states in Section 25-13.1 of the Township Land Use Regulations that “The environmental impact generated by a land development project necessitates a comprehensive analysis of the variety of problems that may result and the actions that can be taken to minimize those problems. This constitutes an environmental impact statement. In evaluating the environmental impact, the Planning Board and the Zoning Board shall not approve any submission until it determines and finds that the proposed development: a.
