1 Public Meeting – April 3, 2012 The Township Council of the Township of West Orange met in the Council Chambers, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on December 7, 2011. Roll Call: Present: Councilman Anderton, Councilman Cirilo, Councilman Krakoviak, Councilwoman McCartney and Council President Spango. Absent : None The Township Council identified and presented for unanimous consent, Item 5 (Minutes), Item 8 (Bills) and Item 11 (Certain Resolutions). On motion made by Councilwoman McCartney and seconded by Councilman Krakoviak, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President stated that this is the scheduled time for the public hearing and asked if there was anyone who wished to be heard. Minutes The Public Minutes of March 6, 2012 were approved as submitted. Bills The Bill List was received and ordered paid. A summary of the Bill List is attached. Resolutions The following Resolutions were adopted: Resolution #61-12 Resolution Authorizing the Municipality to Apply for the 2011 Recycling Tonnage Grant Resolution #63-12 Resolution Approving the Certification List for LOSAP for the Year 2011 *It is noted that Councilwoman Spango recused herself from the above resolution. Resolution #64-12 Resolution Authorizing Raffle Licenses Resolution #65-12 Resolution Amending Resolution 21-12 Authorizing the Payment of $320.00 to Be Paid to the American Society of Composers, Authors and Publishers (ASCAP) for a Yearly Base Licensing Fee That Enables the Township to Use Copyrighted Music at Township Events Resolution #66-12 Request for Subordination of Mortgage – 12 Amos Street, Block 148.01, Lot 10 Resolution #67-12 Resolution for Interlocal Services-Animal Control Between the Township of West Orange and the Borough of North Caldwell Ending December 31, 2012 Resolution #68-12 Resolution Authorizing Two (2) Year Contract with Robert DeFilippis, D.V.M. effective January 1, 2012 and ending December 31, 2013, in the Amount of $8,000.00 in 2012 and $8,160.00 in
3 2013 Resolution #69-12 Resolution Authorizing Sale of Township Owned Land Located at Block 176.08, Lot 14 – Marmon Terrace, Block 176.08, Lot 8 Arnold Terrace, and Block 176.04, Lot 15.01 – Marie & Arnold Terrace, Extended for an Additional Sixty (60) days Resolution #70-12 Resolution Authorizing Contract for Re-Appointment of Jessica Glicker to Service as the Township’s Public Information Officer at a Salary of $3,166.66 Per Month for a Term of One Year ending December 31, 2012 Resolution #71-12 Resolution Authorizing a Window Contract to Grabowski Construction, Inc., 770 Northfield Avenue, West Orange, NJ 07052 in the Amount of $21,120 for Additional Concrete Paved Areas in the Valley Road Parking Lot Resolution #72-12 Resolution Authorizing Tax Rebates Due to Duplicate Payments for First Quarter 2012 Ordinances on Second and Final Reading Ordinance #2355-12 On motion made by Councilwoman McCartney and seconded by Councilman Anderton, CALENDAR YEAR 2012 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A 40A:4-45.14), was taken up on second and final reading by title only. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. On motion made by Councilman Krakoviak and seconded by Councilman Anderton, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”. Ordinances on First Reading
4 Ordinance #2356-12 On motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, SUBSECTION 7-14, 1c, NIGHT PARKING RESTRICTED, SUBSECTION 7-14.2a, PARKING PROHIBITED ON CERTAIN STREETS DURING CERTAIN HOURS OF CERTAIN DAYS AND SUBSECTION 7- 14.7, ALTERNATE SIDE PARKING OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE, MITCHELL STREET AND HAZEL AVENUE, was taken up on first reading by title only. All members voting “Aye”. The Clerk read the ordinance by title only. Following discussion and on motion made by Councilman Krakoviak and seconded by Councilman Anderton, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on April 24, 2012. All members voting “Aye”. Resolution #59-12 Resolution of the Township of West Orange in the County of Essex, New Jersey Authorizing Execution of a Modification Agreement with Respect to the Development of the Downtown Redevelopment Area Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Cirilo, the above mentioned resolution was adopted. Councilman Anderton, Councilman Cirilo, Councilwoman McCartney and Council President Spango voting “Aye”. Councilman Krakoviak voting “Nay”. Resolution #60-12 Resolution of the Township of West Orange in the County of Essex, New Jersey Authorizing an Agreement with Respect to Infrastructure Construction Within the Downtown Redevelopment Area Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Anderton, the above mentioned resolution was adopted. Councilman Anderton, Councilman Cirilo, Councilwoman McCartney and Council President Spango voting “Aye”. Councilman Krakoviak voting “Nay”. Resolution #62-12
5 Resolution Calling for the Restoration of Energy Taxes to Municipalities Following discussion and on motion made by Councilman Krakoviak and seconded by Councilman Cirilo, the above mentioned resolution was tabled. All members voting “Aye” to table. ABC Hearing Resolution #473-12 Disciplinary Hearing – Essex House A motion made by Councilman Anderton to amend paragraph four of Resolution #473-12 and seconded by Councilman Cirilo, was carried. All members voting “Aye”. On motion made by Councilman Cirilo and seconded by Councilman Anderton, the above mentioned resolution was adopted. All members voting “Aye”. The Minutes of this meeting are on file in the Office of the Municipal Clerk.
