1 Conference Meeting – November 10, 2020 The West Orange Township Council met virtually due to the Covid 19 pandemic beginning at 6:40 p.m., Fatima Baez- Aguilar, Clerk Typist II read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975. The annual notice was emailed to the Star Ledger and filed in the Township Clerk’s office on October 31, 2019 and published in the West Orange Chronicle on November 7, 2019. Roll Call – Councilman Guarino, Councilman Krakoviak, Councilwoman Matute-Brown, Councilwoman McCartney, Council President Casalino The Council decided to wait until next meeting to approve the 2021 Council Meeting dates. Michelle Casalino, Council President asked everyone to take a minute of silence in honor of those who have passed away in our Township from Covid19. She also gave a brief status on Redevelopment in the Township. The Council gave their liaison announcements. Resolution(s) At this time the Administration asked that Resolution 215-20 Resolution Authorizing the Issuance of $720,000 Special Emergency Notes for the Payment of Severance Liabilities Resulting from Unanticipated Required Accumulated Absence Payouts in Connection with the Layoff or Retirement of Employees in and by the Township of West Orange, in the County of Essex, New Jersey (Gross) be pulled off the agenda. *Resolution(s) Removed from the Consent Agenda: 211-20 Resolution Authorizing Retention of David Spatz to Assist Planning Board Regarding Possible Redevelopment of Executive Drive (Legal-Trenk) On motion made by Councilman Guarino and seconded by Council President Casalino, the above referenced resolution was approved. Councilman Guarino, Councilwoman Matute-Brown, Councilwoman McCartney and Council President Casalino voting “Aye.” Councilman Krakoviak voting “Nay.” 216-20 Resolution Authorizing an Executive Session to Discuss a Matter of Litigation Specifically, Resolution 217 -20 Authorizing the Settlement of Litigation with Councilman Krakoviak (Legal-Trenk) On motion made by Councilwoman Matute-Brown and seconded by Council President Casalino, the above referenced resolution was approved. Councilman Guarino, Councilwoman Matute-Brown, Councilwoman McCartney and Council President Casalino voting “Aye.” Councilman Krakoviak recused himself. 217-20 Resolution Authorizing Settlement of Litigation with Councilman Krakoviak (Legal-Trenk) On motion made by Councilwoman Matute-Brown and seconded by Council President Casalino, the above referenced resolution was approved. 3 219-20 Resolution Authorizing Retention of Windels Marx Lane & Mittendorf, LLP to Assist Planning Board Regarding Possible Redevelopment of Executive Drive (Legal-Trenk) On motion made by Councilman Guarino and seconded by Council President Casalino, the above referenced resolution was approved. Councilman Guarino, Councilwoman McCartney and Council President Casalino voting “Aye.” Councilman Krakoviak and Councilwoman Matute-Brown voting “Nay.” 225-20 Resolution Authorizing the Chief Financial Officer of the Township of West Orange, in the County of Essex, New Jersey to Submit an Application to the Director of the Division of Local Government Services for Approval of a Special Emergency in the Amount of $7,876,277.10, or Such Other Amount Certified by Such Director for the Purposes Set Forth in N.J.S.A 40A: 4-53(L) and/or N.J.S.A. 40A:4-53(M) (Gross) On motion made by Councilman Guarino and seconded by Council President Casalino, the above referenced resolution was approved. rd - Block 175.08 Lot 11 (Legal-Moon) l. 222-20 Resolution Authorizing an Award of Contract for Snow Plowing and Salting Services for Years 2020-2021 (Lepore) m. 223-20 Resolution Allowing the Release of All Performance Bonds Associated with the Redevelopment Project at 22 Central Avenue to Valley Road Residential Urban Renewal, LLC, One Parker Plaza, Fort Lee, NJ 07024. In Accordance with Municipal Land Use Law, a Performance Bond in the Amount of $147,294.00 was Posted with the Township to Guarantee Completion of Off-Site Improvements Within the Public Rights of Way of Central Avenue and Mitchell Street. The Performance Bond Consisted of a Surety Bond in the Amount of $132,564.60 and a Cash Bond in the Amount of $14,720.40. These Bonds may be Released Subject to Posting of a Maintenance Bond in the Amount of $22,094.10 for a Period of Two Years (Lepore)

4 n. 224-20 Resolution Authorizing the Township of West Orange to Enter into and Execute an Agreement with Vigilant for access to Vigilant’s License Plate Booking Images Database as Part of Vigilant’s Program with Essex County Municipalities and Law Agencies for the rate of $2,262.79 (Legal-Moon) o. 226-20 Introduction of the 2021 Downtown West Orange Alliance Budget (Brill) p. 227-20 Resolution Authorizing Matrix to Submit an Application to the New Jersey Department of Environmental Protection for a Grant to Fund the Implementation of the Remedial Investigation Work Plan for Remediation of the Property Located at 8-10 Central Avenue (Legal-Moon) On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the consent agenda was approved. All members voting “Aye.” Ordinances on Second and Final Reading Ordinance 2620-20 On motion made by Councilman Guarino and seconded by Council President Casalino, An Ordinance Amending and Supplementing Chapter 7, Traffic, Subsection 7-32.2, Restricted Parking Zones, of the Revised General Ordinances of the Township of West Orange – 256 South Valley Road was taken up on second and final reading. All members voting “Aye.” The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and public comment was closed. On motion made by Councilman Guarino and seconded by Councilwoman McCartney, the above referenced ordinance was approved. All members voting “Aye.” Ordinances on First Reading Ordinance 2621-20 On motion made by Councilman Guarino and seconded by Council President Casalino, Ordinance Authorizing Special Emergency Appropriation Pursuant to N.J.S.A. 40A:4-53 for Severance Liabilities Resulting from Unanticipated Required Accumulated Absence Payouts in Connection with the Layoff or Retirement of Employees was approved on first reading, ordered advertised according to law, to come up for second and final reading on November 24, 2020. 5 Ordinance 2622-20 On motion made by Council President Casalino and seconded by Councilwoman McCartney, Refunding Bond Ordinance Providing for the Refunding of All or a Portion of the Outstanding General Obligation Bonds, Series 2011, of the Township of West Orange, in the County of Essex, New Jersey, Appropriating $4,500,000 Therefor and Authorizing the Issuance of $4,500,000 Refunding Bonds of the Township for Financing the Cost Thereof was approved on first reading, ordered advertised according to law, to come up for second and final reading on November 24, 2020. Councilman Guarino, Councilwoman Matute-Brown, Councilwoman McCartney and Council President Casalino voting “Aye.” Councilman Krakoviak voting “Nay”. Ordinance 2623-20 On motion made by Council President Casalino and seconded by Councilwoman McCartney, Ordinance Authorizing a Special Emergency Appropriation in the Amount of $7,876,277.10, or Such Other Amount Certified by the Director of the Division of Local Government Services, for the Purposes Set Forth in N.J.S.A. 40A:4-53(L) and/or N.J.S.A. 40A:4-53(M), In and By the Township of West Orange, in the County of Essex, New Jersey was approved on first reading, ordered advertised according to law, to come up for second and final reading on November 24, 2020. Pending Matters/New Matters/Council Discussion The following items were discussed: Council President Casalino requested an update on the bathrooms in the Fire Stations from Administration. The Council discussed Open Space and appraisals for Rock Spring and Crestmont. They also discussed the Tree Ordinance. At 11:32 p.m., on motion made by Councilwoman McCartney and seconded by Councilwoman Matute-Brown, the Council Meeting was adjourned. All members voting “Aye. ABC Hearing Resolution 657-20 On motion made by Councilwoman McCartney and seconded by Council President Casalino, Hearing on Renewal for Plenary Retail Consumption, Distribution and Club Licenses for the 2020-2021 License Term was approved. All members voting “Aye.” The Minutes of this meeting are on file in the Office of the Municipal Clerk.
