48 (Pages 186 to 189) Page 186 1 Because you are doing construction. Installing a 2 fence is construction; would we agree? 3 MR. ANDERSON: It is. 4 MR. WEISLEDER: And that is -- is it 5 also considered development? 6 MR. ANDERSON: It's not by definition 7 -- 8 MR. WEISLEDER: Okay. 9 MR. ANDERSON: -- because it's not 10 part of the disturbed area. But it is only periodic 11 fence posts and -- 12 MR. WEISLEDER: Are those permanent or 13 they will be removed? 14 MR. ANDERSON: No, they're permanent 15 fence posts and -- 16 MR. WEISLEDER: Okay. So in the last 17 four years, have you personally walked through this 18 forest? 19 MR. ANDERSON: In the last how many 20 years? 21 MR. WEISLEDER: Four. 22 MR. ANDERSON: Yes. 23 MR. WEISLEDER: Since that study was 24 done. 25 MR. ANDERSON: Absolutely. Page 187 1 MR. WEISLEDER: Would you agree that 2 there is a lot of garbage and other debris that has 3 destroyed this forest as well? 4 MR. ANDERSON: I would, yes. 5 MR. WEISLEDER: Okay, so it's not just 6 the deer, it's also the forest, so in order for the 7 area -- would you agree that the area that is going 8 to be fenced in needs to be cleaned up first so it 9 can prosper according to this plan or are we just 10 going to put up a fence around a bunch of garbage 11 and -- and other animals? 12 MR. ANDERSON: Well, I know the 13 applicant cleans up various things but there seems 14 to be additional waste deposited there on a regular 15 basis and so, yes, I think they would -- as 16 installing deer fence, they would clean up the area 17 of human debris that -- debris humans have left 18 there -- 19 MR. WEISLEDER: Okay. 20 MR. ANDERSON: -- and -- 21 MR. WEISLEDER: Thank you. And my 22 last question is, I believe you said that those on 23 Howell Drive might see some of the corner building 24 of D where nobody else is going to see the other 25 buildings, so is that true or false? Page 188 1 MR. ANDERSON: I think you -- from 2 that vantage point from the house I was pointing to, 3 we would probably have to enhance the landscaping 4 around that corner of the building a little bit more 5 to provide additional buffering. 6 MR. WEISLEDER: So that would include 7 some additional trees that you are not already 8 planning for? 9 MR. ANDERSON: That's correct. 10 MR. WEISLEDER: Okay, so your 11 testimony today is that you would add more coverage, 12 more trees, to prevent what you said

ANDERSON: They may but, you know, 15 we have no objection to making modifications. We 16 have review letters from the town engineer's office, 17 from the environmental consultant's office and -- 18 regarding changes species and maybe potentially 19 adding in a tree here or there, and there's other 20 circumstances like what you're describing that have 21 come up now, and we're flexible with adding some 22 additional landscaping. 23 MR. WEISLEDER: Okay, and my final 24 question is: Were the residents of Howell Drive 25 consulted by your group as far as sight-line balloon Page 189 1 testing or other things like you did with -- sorry, 2 I can't remember the -- with the community, with the 3 other community on the other side? 4 MR. ANDERSON: I don't believe they 5 were a party to this -- to the agreement, so -- 6 MR. WEISLEDER: Why not? 7 MR. AFRAN: Could you repeat that? 8 I'm so sorry. 9 MR. WEISLEDER: I just wondered why 10 the folks in the condo association were given the 11 opportunity to have a balloon test or not but the 12 residents of Howell Drive, who's going to be closest 13 to Building D and have a stronger sight line, not be 14 included in that discussion. 15 MR. ANDERSON: I think it's a legal 16 issue in terms of who is included in the settlement 17 agreement, it's not -- it's not -- certainly not an 18 engineering issue that I've testified to. It's -- 19 the settlement agreement was between the distinct 20 parties and that's all -- 21 MR. WEISLEDER: I agree. 22 MR. ANDERSON: -- that was included, 23 it wasn't based on engineering. 24 MR. WEISLEDER: So would you be open 25 to doing a sight-line test or a balloon test on that
