I don't have3 A. an answer for that.4 Okay.5 Q. Has, and I referred to the slope in my question,6 but obviously there are several neighborhoods7 surrounding all of this, they're not all on a slope.8 Has any measurement been taken as to whether, it's the9 same question. Has any measurement been taken whether10 the top of the building, the height of the building,11 exceeds the tree line as seen from these other12 neighborhoods?13 Have not.14 A. Okay.15 Q. One final question that I don't think you fully16 addressed, not that it's your fault. It was a question17 from the public, I don't think we got to a full answer18 on the point.19 In case of an emergency in each of the buildings20 where is there built in assembly point? I know there's21 some places of refuge you referred to, but is there a22 general assembly point that will be structurally23 available and easily used for assembling in case of an24 emergency?25 34 So I did give this testimony that there would be1 A. an area of refuge provided on the building at each2 floor.3 On each floor?4 Q. Yes, sir.5 A. So those will be -- in general how large are6 Q. they? Are they uniform throughout the project in size.7 It usually would be a small area because these8 A. are typically used by somebody who would be mobility9 impaired, so not for the general public who would go10 down the stairways and go to a public way which would11 typically be the front parking areas of the building.12 Okay.13 Q. So generally the emergency stairways will lead to14 fronts of the buildings?15 It's just an additional protective safety16 A. element.17 The refuge?18 Q. The area of refuge, correct.19 A. Thank you.20 Q. MR. AFRAN: Mr. Chairman, that concludes my21 cross. I think members of the public sitting next to me22 said he had a question, I don't know that it's23 appropriate at this time or not.24 CHAIRMAN BAGOFF: Well, we had questions25 35 from members of the public already prior to your1 questioning.2 MR. AFRAN: I'm sorry.3 CHAIRMAN BAGOFF: We did have questions from4 the members of the public prior to your questioning.5 MR. AFRAN: I'm not endorsing or not6 endorsing it. I'm just pointing it out.7 CHAIRMAN BAGOFF: I will allow another 208 minutes for questions from the

members of the public prior to your questioning.5 MR. AFRAN: I'm not endorsing or not6 endorsing it. I'm just pointing it out.7 CHAIRMAN BAGOFF: I will allow another 208 minutes for questions from the public.9 THE PUBLIC: Seth Weisleder, S-E-T-H,10 W-E-I-S-L-E-D-E-R. West Orange.11 My question is on Building D and as the12 architect the only, Building D is the only building with13 access to the rooftop to be used?14 THE WITNESS: Only building with a habitable15 roof area.16 THE PUBLIC: Okay.17 Is there any reason why the other buildings18 don't have habitable roof areas? They're all similar.19 THE WITNESS: It was, it was determined to20 put them all in one, one building as part of the design.21 THE PUBLIC: Okay.22 Any particular reason why Building D and not23 Building C or B?24 THE WITNESS: Not in particular.25 36 THE PUBLIC: So if we could bring up that1 slide I guess with that slope line. Because there's a2 little image there that I wanted to look at on Building3 D. I noticed that Building D has some structures on it,4 is that correct? On the top. Roof top access. Yeah.5 So if you could zoom in on the left-hand side there6 showing the, showing the rooftop.7 So I'm guessing this diagram shows cars8 underneath of the first floor and then there's four9 stories above that, correct?10 THE WITNESS: That's correct.11 THE PUBLIC: With the rooftop access showing12 about six people on top there and there's some13 structures?14 THE WITNESS: Correct.15 THE PUBLIC: So my question is, are those16 structures permanent structures on the building?17 THE WITNESS: If you look at the18 architectural elevations these are clearly denoted.19 Some are the bulkheads for access to the roof and others20 are going to be open air pergolas.21 THE PUBLIC: So those pergolas are going to22 be permanent structures, and how high will they be?23 Because I don't believe I saw any measurements for the24 height of that and I was wondering if that exceeds the25
