Conference Meeting — October 29, 2024 The Conference meeting began at 6:34 p.m., the Municipal Clerk read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975. The annual notice was emailed to the Star Ledger and filed in the Township Clerk’s office on November 21, 2023, and published in the West Orange Chronicle on November 30, 2023. Roll Call —Councilwoman Casalino, Councilwoman Ghebremicael, Councilwoman Scarpa, Councilwoman Williams, Council President Rutherford, Mayor McCartney Councilwoman Ghebremicael joined the meeting via Zoom as she wasn’t feeling well. d Accepting Certain Public Improvements, Including The Rights Of Way At Colonial Woods North And Extension Of Nance Road And Public Easements Shown On The Filed Map Entitled “Final Plat-Block 173, Lot 2and Block 172.29, Lot 40.02, Colonial Woods North, Township Of West Orange, Essex County, New Jersey” (Carballo) On motion made by Councilwoman Ghebremicael and seconded by Councilwoman Williams, the above referenced resolution was amended and approved as follows: “WHEREAS, the Township Engineer recommends that a payment to the Township of $23,275.00 be accepted from the Developer to be used 2
solely for the planting of trees that, with the consent of the respective property owners, were not planted in the development”. All members present voting “Aye.” Resolution 308-24 Resolution Authorizing an Emergency Appropriation for Storm Sewer CCTV Inspection and Pavement Investigation of the Township’s Storm Sewer and Pavement along Wellington Avenue to Colonelli Bros., Inc., 409 S. River Street, Hackensack, NJ 07601, in an Amount NTE $8,930.00 (Carballo) On motion made by Councilwoman Williams and seconded by Council President Rutherford, the above referenced resolution was approved. All members present voting “Aye.” Ordinance(s) on Second and Final Reading Ord. 2876-24 On motion made by Councilwoman Casalino and seconded by Councilwoman Williams, An Ordinance Amending And Supplementing Chapter 7, Traffic, Subsection 7-14.6 Winter Parking Restrictions, Of The Revised General Ordinances Of The Township Of West Orange was taken up on second and final reading. All members present voting “Aye.” The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one that wished to be heard and the public hearing on this Ordinance was closed. On motion made by Councilwoman Williams and seconded by Councilwoman Casalino, the above referenced ordinance was adopted. All members present voting “Aye.” Ordinance(s) on First Reading Ord. 2879-24 On motion made by Councilwoman Casalino and seconded by Councilwoman Ghebremicael, An Ordinance Amending Chapter 3, Section 17.1 of the Revised General Ordinances of the Township of West Orange (Ordinances And Resolutions - Preparation) was approved on first reading, ordered advertised according to law, to come up for second and final reading on November 12, 2024. All members present voting “Aye.” Pending Matters/New Matters/Council Discussion ¢ Kemistry, LLC-Amended Application for a Resolution of Local Support (Legal-Moon) Councilwoman Williams recused herself and exited chambers during the discussion. On motion made by Councilwoman Ghebremicael and seconded by Council President Rutherford, the Council voted on whether to allow Kemistry an extension to November 12, 2024 to cure their application. 3
Councilwoman Ghebremicael and Council Rutherford voting “Aye.” Councilwoman Casalino and Councilwoman Scarpa voting “Nay.” The motion failed. On motion made by Councilwoman Casalino and seconded by Council President Rutherford, the Council voted to allow Kemistry an extension of one-week to cure their application. All members present voting “Aye.” Stormwater Management Ordinance Discussion regarding Single Occupancy Restrooms Status of Township Revaluation 20" Century Film Studio At 9:27 p.m., on motion made by Councilwoman Williams and seconded by Councilwoman Casalino, the Council adjourned their public meeting and entered into an ABC Hearing. All members present voting “Aye.” ABC Hearing 753-24 Person to Person Transfer of Retail Distribution License No. 0722-44-001-006, JJS1, LLC t/a Main Street Liquors to El Patio Liquor Store, LLC t/a El Patio Liquor Store, 56 Main Street, West Orange, NJ 07052 On motion made by Council President Rutherford and seconded by Councilwoman Williams, the above referenced resolution was approved. All members present voting “Aye.” At 9:30 p.m., on motion made by Councilwoman Williams and seconded by Councilwoman Ghebremicael, the ABC Hearing was adjourned.
