Because they're already5 coming down into our neighborhood and they don't just6 come along the side of my house and there's a family of,7 two families more than eight to ten and I know you were8 just saying what you observed while you were there.9 There's a lot more. A lot. And I like the deer but the10 thing is they also come into the roads in our11 neighborhood and I feel like regardless of when the deer12 fence -- the deer fencing comes up it's going to squeeze13 them out or in and amongst the construction. See what14 I'm saying?15 THE WITNESS: Again, I can't answer your16 question as to when the deer fencing will be installed,17 because I'm not in control of the schedule of18 construction.19 THE PUBLIC: No, but in someways --20 THE WITNESS: I just can't answer it.21 THE PUBLIC: It doesn't matter when it goes22 up really, because either way the construction is going23 to effect the deer, right? And there are trees and24 everything. There's going to be less area for them to25 126 go and you assume they're just going to stay in that1 area, but I guess my question is, isn't that somehow2 incorrect, because aren't they going to be squeezed out3 of that area?4 THE WITNESS: First, let me literally state5 that I did not say they would stay in the area. I said6 that they would move in all directions as they do today.7 THE PUBLIC: I thought you meant, sorry. I8 thought you meant, maybe I misunderstood.9 THE WITNESS: And I may not have been clear.10 THE PUBLIC: The neon green area.11 THE WITNESS: Let's be clear. What I --12 during construction deer obviously aren't going to stick13 around with a backhoe sitting there. I can't say they14 will, unless maybe they will, I don't know. But, you15 know, sure, any kind of construction activity disturbs16 wildlife, that's not anything anyone can argue with.17 THE PUBLIC: Okay. Fair enough.18 You said that the areas outside -- in19 between the deer fencing would just grow as normal and20 as is. In the neon, right?21 THE WITNESS: Yeah. Might it effect the root systems immediately5 adjacent to an area of disturbance, it's possible,6 certainly. There is a point of which we can't control7 that.8 THE PUBLIC: So you're saying it would be9 limited to just the areas right around it?10 THE WITNESS: Yeah. We're not in here with11 -- we. They're not in here with heavy equipment. There12 is nothing to disturb, thus the term undisturbed.13 THE PUBLIC: That's kind of --14 THE WITNESS: Along this area. If for15 example, let's just hypothetically say, to answer your16 question, try to answer your question correctly, let's17 say for hypothetical argument there's a tree literally18 right up against what might be a curb line, assume19 there's a curb line in there. And I excavate here to20 cut that curb line in the road and that tree is right21 there and I disturb those roots, there's a good chance22 that trees going to die right up adjacent to it, sure.23 THE PUBLIC: Okay. Great.24 So my question is this, ist that, so you're25 128 saying that little strip of white going up that's the1 only place that the construction equipment is going to2 be to build that bigger area of where the buildings are?3 THE WITNESS: As I understand it, and I4 don't know for certain how they're coming in, but it's5 got to come in on a road. I mean, so that's the only6 limitation I can give you. You can't move construction7 equipment of a road, so I don't know the answer to your8 question, I would defer to the applicant. I presume9 they'd build an access road first and then they'd start10 construction. I presume that's how it's done, but I11 don't know that, I can't testify to that.12 THE PUBLIC: Yeah, it's just hard for me to13 visualize. I think about how all our decks were just14 done and our siding and on a microlevel the area that15 they were actually building or replacing, it was16 impacted to a much larger degree on the outside area.17 So I just have a hard time thinking
