So the3 ridge is really just your high point, your change in4 grade. So you could see that the top of the ridge and5 it slopes off to the east here, it slopes off to the6 west. So I think there is testimony on there that the7 closest point it gets to seven feet from that ridge. In8 this corner it does, that corner as well. And then, so9 really the testimony from Sam Kleinberg of my office, he10 was saying there is a separation where you do have a11 flatter area on the ridge before you're hitting the two12 to one or in some cases one to one slope. So --13 MAYOR McCARTNEY: That's my question.14 MR. MacNEILL: Okay.15 MAYOR MacNEILL: What is that distance?16 MR. MacNEILL: So this distance, I believe,17 I don't want to say off the top of my head, I don't have18 that in front of me, but there was testimony provided on19 the exact distance from here to there. What I can do,20 if there's any other questions, I can scale that off21 real quick as well, just on what I have here.22 MAYOR McCARTNEY: Yeah, I would like to23 know.24 MR. MacNEILL: I'll do that on the side. If25 34 there's any other questions that the board may have.1 MAYOR McCARTNEY: My other question -- can I2 keep going. All right. My other question was,3 clarification was on the sanitary sewer capacity for the4 township.5 MR. MacNEILL: Okay.6 MAYOR McCARTNEY: The question, do we7 satisfy that?8 MR. MacNEILL: Yeah, so sewer capacity,9 obviously is an issue in the township, right. There's10 -- the real problem that the township is experiencing is11 there is not an overall study that outlines, here's the12 current capacity of the system. Here is what is being13 sent to the system. What the applicant has agreed to is14 upsizing piping in the municipal system to meet their15 capacity plus the additional or the existing development16 up to a certain extent, which is kind of outlined in17 our, there is a sewer review letter dated December 8,18 2025 from my office to the township engineer, which does19 outline some comments and some additional analysis that20 under the sewer review with the township will have to be21 completed by the applicant before the township engineer,22 I don't want to speak for her, but before she will sign23 off on the TWA

is that20 under the sewer review with the township will have to be21 completed by the applicant before the township engineer,22 I don't want to speak for her, but before she will sign23 off on the TWA application.24 MAYOR McCARTNEY: And that the sole cost and25 35 expense of all of that would be on the developer?1 MR. MacNEILL: That is outside of my2 understanding currently.3 MAYOR McCARTNEY: Is that a condition?4 MR. MacNEILL: I'm not sure if that's in the5 agreement, that needs to be taken place between the6 applicant and the township.7 MAYOR McCARTNEY: Right. I believe that is8 in the agreement. So is that a condition or is that --9 MS. McGOVERN: Is it in the conditions that10 we have with the sewer?11 MAYOR McCARTNEY: It's not. Well, you12 didn't mention it so can we add it or that this13 particular project is at the sole expense and cost --14 MS. McGOVERN: Okay.15 MAYOR McCARTNEY: It is in the agreement.16 It is. On Page 6.17 MS. McGOVERN: In the ordinance it is or in18 the --19 MAYOR McCARTNEY: That was in the agreement.20 MS. McGOVERN: In the settlement agreement21 you're referencing?22 CHAIRMAN BAGOFF: The ordinance. In the23 ordinance.24 MS. McGOVERN: What's the -- Mayor, can you25 36 point out the ordinance you're taking about?1 MAYOR McCARTNEY: I don't see anything.2 Okay. I don't see anything about the sewer in there.3 MS. McGOVERN: No, it's not in the4 ordinance. That wouldn't be -- that would part of, you5 know, your site plan or requirements within the township6 and then if there's a side agreement with it, we're not7 reviewing that. We don't have any say over that. But8 we, meaning the Planning Board, does not have any say9 over that. That's not part of your review.10 MR. KLEIN: But they have to be able to11 provide sewer?12 MS. McGOVERN: Exactly.13 MR. KLEIN: Right.14 MS. McGOVERN: Right. Who pays for it --15 MR. KLEIN: Right. Not our issue.16 MR. MacNEILL: And just to answer your17 initial question, I apologize Mayor, the slope is about18 40 feet at the closest point to 120 feet from the ridge19 line.20 MR. KLEIN: Can you put that picture back21 up, Joe.22 Mr. MacNeill: Minimum 40 feet from the23 ridge line to the steep slope area.24 MAYOR McCARTNEY: Okay. So wait, but let's25
