Show all pagesZ:\Resolutions\2010\31-10 Stimulus Refund-Tega Bakery.doc 31-10 February 9, 2010 RESOLUTION WHEREAS, On July 27, 2009, Governor Corzine signed into law the NJ Economic Stimulus Act of 2009; and WHEREAS, part of this law temporarily suspends the Non-Residential Development Fee Act, which requires developers to pay a 2.5% non-residential development fee; and WHEREAS, under the NJ Economic Stimulus Act of 2009 any developer that has paid the 2.5% non-residential development fee since July 17, 2008 is entitled to claim a .05% refund based on certain criteria; and WHEREAS, the Township of West Orange Department of Planning and Development has determined that Tega Bakery, LLC is entitled to a refund in the amount of $2,479.85; and WHEREAS, the Township is entitled to seek a reimbursement from the State of New Jersey for any refunds issued as a result of the passage of this law; NOW, THEREFORE, BE IT HEREBY RESOLVED, by the Township Council of the Township of West Orange that the Chief Financial Officer be and hereby is authorized to issue a refund to Tega Bakery, LLC, 55 Park Street, Montclair, New Jersey in the amount of $2,479.85, which funds shall be withdrawn from the Township’s Developer Fee Account.
