Public Meeting – JANUARY 4, 2011 The Township Council of the Township of West Orange met in the Municipal Building, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 19, 2010. Roll Call: Present: Councilman Cirilo, Councilwoman McCartney, Council woman Spango, Councilman Krakoviak, Council President Anderton and Mayor Parisi Absent: None The Township identified and presented for unanimous consent, Item 11 (Certain Resolutions). These items are considered to be routine in nature by the Council and will be enacted by one motion. There will be no separate discussion of these items. If any discussion is desired by the Council, or the public, that particular item will be removed from the Consent Agenda and will be considered separately. On motion made by Councilman Cirilo and seconded by Councilwoman McCartney, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time. Christine Bosco, 4 Masson Place, West Orange, commented on the transcripts of the zoning board meetings regarding the Essex House/Shopping Plaza project. Earl Turner, Mt. Pleasant Avenue, West Orange commented on the Local Municipal Budget. Brian Goldberg, Pleasant Valley Way, West Orange, stated that the first budget advisory committee meeting was successful. Rosary Morelli, 22 Ralph Road, West Orange, commented on the recent blizzard and thanked the administration and council for supporting the snow removal ordinance. Anthony Pugliesi, Public Information Officer for Essex County, commented on the Deer Management Program. 1

Aaron Spoole, 14 Conforti Avenue, West Orange, stated that the Reverse 911 System be utilized more during a snow storm. April Graham, Oakridge Road, West Orange, commented on snow removal in the township. There was no one else who wished to be heard and the public hearing was closed. Resolutions The following Resolutions were adopted: Resolution #01-11 Resolution Awarding a Cash Management Plan for 2011 Resolution #02-11 Resolution Finding Developers in Default of their Obligations Secured by Western Surety Company Bond No. 70922793 for Improvements Associated with 2 Henry Street, West Orange, NJ Resolution #03-11 Resolution Authorizing the Tax Collector to Rebate Payment to Listed Taxpayer Pursuant to Final Judgment by the Tax Court of New Jersey Resolution #04-11 Resolution Authorizing the Temporary Budget – 2011 Resolution #05-11 Resolution Authorizing an Executive Session to Discuss Matter(s) of Litigation and Contract Negotiations Ordinances on Second and Final Reading Ordinance #2297-10 On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, An Ordinance Amending and Supplementing Chapter 7, Subsection 7-13, Parking Prohibited at All Times on Certain Streets, of the Revised General Ordinances of the Township of West Orange – Kelly Drive and Vizcaya Boulevard, West Orange, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. 2

There was no one who wished to be heard and the public hearing was closed. On motion made by Councilman Krakoviak and seconded by Councilwoman Spango, the above mentioned ordinance was tabled. All members voting “Aye” to table. Ordinance #2298-10 On motion made by Councilman Cirilo and seconded by Councilwoman Spango, AN ORDINANCE AMENDING AND SUPPLEMENTNG CHAPTER 7, TRAFFIC, SUBSECTION 7-32.2, RESTRICTED PARKING ZONES, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE – HANDICAPPED PARKING – 5 PARK DRIVE SOUTH, WEST ORANGE, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. Susan Lenczyk, 5 Park Drive South, West Orange, commented on the above ordinance and thanked the Council and the Administration for their support. There was no one else who wished to be heard and the public hearing was closed. On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”. Ordinance #2299-10 On motion made by Councilwoman Spango and seconded by Councilman Krakoviak, BOND ORDINANCE AUTHORIZING THE UPGRADE TO THE MUNICIPAL BUILDING TELECOMMUNICATIONS SYSTEM IN AND FOR THE TOWNSHIP OF WEST ORANGE, NJ APPROPRIATING $245,000 THEREFORE AND AUTHORIZING THE ISSUANCE OF $232,750 BONDS OR NOTES TO FINANCE PART OF THE COST THEREOF, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. Earl Turner, Mt. Pleasant Place, West Orange commented on the above ordinance. 3

Christine Bosco, 4 Masson Place, West Orange commented on the above ordinance. Rosary Morelli, 22 Ralph Road, West Orange, commented on the above ordinance. Don O’Dea, Rosemont Court, West Orange commented on the Downtown SID Redevelopment Project. There was no one else who wished to be heard and the public hearing was closed. On motion made by Councilman Krakoviak and seconded by Councilwoman Spango, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”. Ordinance #2300-10 On motion made by Councilwoman Spango and seconded by Councilman Krakoviak, BOND ORDINANCE AMENDING BOND ORDINANCE 1760-01 FINALLY ADOPTED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, NEW JERSEY, ON APRIL 10, 2001, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and read the ordinance by title only. Ordinances on First Reading Ordinance #2301-11 On motion made by Councilman Krakoviak and seconded by Councilman Cirilo, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 14, SECTION 8.1 OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE ENTITLED “MAINTENANCE OF EXTERIOR OF PREMISES”, was taken up on first reading by title only. 4

All members voting “Aye”. The Clerk read the ordinance by title only. On motion made by Councilman Krakoviak and seconded by Councilwoman Spango, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on January 18, 2011. All members voting “Aye”. Ordinance #2302-11 On motion made by Councilman Cirilo and seconded by Councilwoman McCartney, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 20 SECTION 5.1 OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE ENTITLED “MAINTENANCE OF EXTERIOR OF PREMISES”, was taken up on first reading by title only. All members voting “Aye”. The Clerk read the ordinance by title only. Following discussion and on motion made by Councilman Cirilo and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on January 18, 2011. All members voting “Aye”. On motion made by Councilman Cirilo and seconded by Councilwoman McCartney, the Council went into Executive Session to discuss Matter(s) of Litigation and Contract Negotiations, specifically the mattersof West Essex Highlands and Personnel-Employee Contracts. All members voting “Aye”. The Minutes of this meeting are on file in the Office of the Municipal Clerk.
