125-10 May 25, 2010 RESOLUTION TO AUTHORIZE SALE OR ASSIGNMENT OF CERTAIN CELL TOWER LEASES WHEREAS, the Township of West Orange has four (4) cell tower locations that are presently being leased by Mobile Wireless Communication Companies; and WHEREAS, each location has long term lease contracts which generate an annual income for the Township; and WHEREAS, the Township is exploring the possibility of selling or assigning its interests in certain cell tower leases; and WHEREAS, the Township has hired through resolution the Telecom Group Management Company to assist with the preparation of a bid package; and WHEREAS, the bid will bundle all information relating to the potential sale and/or assignment of the cell tower leases for these four (4) locations and allow the Township to sell or assign its interest in these leases to the bidder that offers the best financial arrangement to the Township of West Orange; and WHEREAS, the locations that will be considered are: Fire House #1 on Valley Road, Fire House #4 on Pleasant Valley Way, Stagg Field on St. Cloud Avenue and Liberty Middle School on Mt. Pleasant Avenue; NOW BE IT RESOLVED by the Township Council of the Township of West Orange that the Purchasing Agent be and hereby is authorized to prepare and publish notice of bids for the sale and/or assignment of certain cell tower leases; and BE IT FURTHER RESOLVED that said notice of sealed bids shall be in accordance with the Local Lands and Buildings Law 40A:12-13 and such sealed bids will be publicly received and opened at the date and time specified the notice.
