AGENDA July 20, 2010 Township of West Orange 66 Main Street – 7:00 p.m. This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on December 3, 2009. A notice of this meeting was also posted on the Bulletin Board in the Municipal Building, West Orange and filed in the office of the Municipal Clerk of the Township of West Orange on December 3, 2009. Statement of Decorum In all matters not provided for in subsection 3-15.1 and except upon consent of the Council President, each person addressing the Council pursuant to this subsection shall be required to limit his or her remarks to five (5) minutes, and shall at no time engage in any personally offensive or abusive remarks. Ordinances on First Reading a. 2274-10 An Ordinance Amending & Supplementing Chapter 25 Section 28 of the General Ordinances of the Township of West Orange, Entitled “Steep Slope and Natural Features Ordinance” The steep slope amended ordinance adds additional restrictions of State open waters, wetlands, wetland transition areas, flood hazard areas, floodways and riparian zone. This is warranted to prevent flooding, protect water quality, preserve wildlife and aquatic habitat. b. 2275-10 An Ordinance Amending & Supplementing Chapter 25 Section 3.2 of the General Ordinances of the Township of West Orange Entitled “Zone Map and Table of District Regulations” The purpose of this ordinance is to change the current zoning for the lands known as Block 179, Lot 32

l Ordinances of the Township of West Orange Entitled “Zone Map and Table of District Regulations” The purpose of this ordinance is to change the current zoning for the lands known as Block 179, Lot 32 in accordance with the 2010 Master Plan Reexamination Plan. Specifically, this ordinance removes the zoning parameters added following the 2004 Master Plan Reexamination Report and limits the zoning to standard development within a R-2 and R-3 zone. c. 2276-10 An Ordinance Amending and Supplementing Chapter 7, Traffic, Subsection 7-20, Stop Intersections of the Revised General Ordinances of the Township of West Orange. This Ordinance proposes designating the intersection of Birchwood Avenue and Lessing Road as a Stop Intersection with Stop Signs on Birchwood Avenue. Currently this intersection is only designated as a Yield Intersection with Yield Signs on Birchwood Avenue. d. 2277-10 An Ordinance Amending and Supplementing Chapter 7, Traffic, Subsection 7-32.2, Restricted Parking Zones of the Township of West Orange. This Ordinance proposes designating on-street handicapped parking stalls in front of two residences, 79 Mitchell Street and 18 Elm Street, for the exclusive use by a resident of each household who has a Disabled Persons ID issued by the Motor Vehicles Commission. Parking in these stalls will still be subject to other parking regulations

of Chapter 7 namely the Alternate Side Parking Regulations. *10. Resolutions a. 182-10 Resolution Authorizing the Township to Apply for the No-Match Sustainable Jersey Small Grants Program Sponsored by Wal Mart Stores, Inc., the New Jersey League of Municipalities Education Foundation and the NJLM Conference of Mayors’ Committee for a Green Future Resolution approving the West Orange Energy Commission's submission of a grant proposal to the Sustainable Jersey Small Grants Program for $10,000.00 to support rain barrel purchases, associated artist fees for a public art water conservation awareness project, and supporting awareness materials. b. 183-10 Resolution Authorizing a Contract With Garden State Laboratories, Inc. for Public Health Testing Services For a One Year Period Beginning January 1, 2010 – December 31, 2010 in the Amount of $5,000. to be Paid in Half Yearly Installments Garden State Laboratory Service Contract 2010 - $5,000: GSL agrees to provide laboratory analysis and supplies required to perform mandatory sampling of food, water and other environmental samples for the purpose of determining bacteria, such as E. coli and other disease causing agents in potentially hazardous foods, on utensils used in food preparation, and in the environmental. c. 184-10 Resolution Authorizing the Appointment of a New Member to the West Orange Domestic Violence Response Team for 2010 d. 185-10 Resolution Supporting the U.S. Conference of Mayors To Urge Congress to Support the Education, Conservation and Community Development Missions of Public Zoos and Aquariums e. 186-10 Resolution Authorizing a Refund to Certain Individuals for the 2010 Summer Park Program in the Total Amount of $660. (1) Hazel School gives a scholarship to 3 students to attend summer camp-one of the students has a schedule conflict and will not be able to attend $315.00 refund back to Hazel Ave School. (2) Resident has partial custody and was advised after registration that his ex spouse will be taking child on vacation during camp days. ($370.00 fee, minus $25.00 processing fee, refund back to resident $345.00). f. 187-10 Resolution Authorizing Raffle Licenses g. 188-10 Resolution Appointing a Temporary Councilmember to Fill the Vacant Seat Left by Robert D. Parisi h. 189-10 Resolution Authorizing the Tax Collector to Rebate Payment to Listed Taxpayer Pursuant to Final Judgment by the Tax

Parisi h. 189-10 Resolution Authorizing the Tax Collector to Rebate Payment to Listed Taxpayer Pursuant to Final Judgment by the Tax Court of New Jersey i. 190-10 Resolution Authorizing the Increase of the Public Bidding Threshold From $29,000. to $36,000. The Governor in conjunction with the Department of Treasury adjusts the dollar amount Municipalities use for the bid threshold every 5 years. All purchases made over this amount must be publicly advertised as a bid. Purchases made under this amount do not have to be advertised. j. 191-10 Resolution Authorizing a Contract With the Police Athletic League for the Provision of Recreational Services and Social Services to the Residents of West Orange in the Amount of $12,000. k. 192-10 Resolution Authorizing a ContractWith the Mountain Top League for the Provision of Recreational Services and Social Services to the Residents of West Orange in the Amount of $9,500. l. 193-10 Resolution Authorizing a ContractWith the West Orange PTA Project Graduation for the Provision of Recreational Services and Social Services to the Residents of West Orange in the Amount of $2,500. m. 194-10 Resolution Authorizing the Mayor and Director of Planning and Development to Apply for the State of New Jersey Green Acres Program During Fall 2010 for $1,000,000. in Open Space Acquisition Funds n. 195-10 Emergency Temporary Appropriations-2010 (7) This allows the Township to pay claims prior to the official budget being adopted. o. 196-10 Resolution authorizing the execution of a Service Agreement with Public Service Electric and Gas Company and the issuance of a Purchase Order in the amount of $222,156.28. This Resolution authorizes the Township to enter into a Service Agreement with Public Service Electric & Gas Company to authorize them to install decorative street lights along portions of the Downtown West Orange Corridor. The cost of this work is $222,156.28 for 78 gas replica lighting fixtures. These lighting improvements are part of the Downtown West Orange Streetscape and Traffic Improvement Plans for the St. Mark’s and Lourdes/Eagle Rock

Sections. p. 197-10 Resolution authorizing Change Order No. 1 for CMS Construction, Inc., 157 Sherman Avenue, Newark, New Jersey in the amount of $10,388.00 for the project Pleasant Valley Way Sidewalks. This Resolution authorizing Change Order No. 1 increases the contract amount with CMS Construction by $10,388.00 from $143,645.00 to $154,033.00. The additional costs are associated with the As-Built quantities required to complete the project. The limits of construction were not increased nor were any supplemental construction items required. 11. ABC Hearing a.
