Public Meeting – May 17, 2011 The Township Council of the Township of West Orange met in the Municipal Building, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk, read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 19, 2010. Roll Call: Present: Councilman Cirilo, Councilman Krakoviak, Councilwoman McCartney, Councilwoman Spango, and Council President Anderton Absent: None The Township identified and presented for unanimous consent, Item 5 (Minutes), Item 8 (Bills), and Item 11 (Resolutions). On motion made by Councilwoman Spango and seconded by Councilman Cirilo, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time. Kenneth Anderson, 137 Leonardo Drive, West Orange, NJ commented on a potentially dangerous traffic situation on Laird Drive. There was no one else who wished to be heard and the public hearing was closed. Minutes The public minutes of April 12, 2011 and Executive Session Minutes for February 22, 2011 were approved as submitted. Bills The Bill List was received and ordered paid. Resolution Authorizing the Township of West Orange to Enter Into a Mutual Release and Settlement of All Claims with Telgian Corporation and Sears Holding Corporation Resolution #116-11 Resolution Authorizing the Tax Collector to Refund Duplicate Tax Payments to Taxpayers Listed Resolution #117-11 Resolution Authorizing Window Contract for Doctor Computer, 21 Ridgewood Drive, Livingston, NJ 07039, $26,008.00 Computer Equipment Replacement for Admin/Finance Departments Ordinances on Second and Final Reading Ordinance #2318-11 On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7-32.2, RESTRICTED PARKING ZONES OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE, HANDICAPPED PARKING, 56 Elm Street and 9 Wheeler Street, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. Carolyn Chase, 9 Wheeler Street, West Orange commented on the above ordinance. Rose Thimoleon and Cluny Colimon, 56 Elm Street commented on the above ordinance. There was no one else who wished to be heard and the public hearing was closed. On motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. All members voting “Aye”. Ordinances on First Reading Ordinance #2320-11 On motion made by Councilwoman Spango and seconded by Councilwoman McCartney, AN ORDINANCE REPEALING AND AMENDING CHAPTER 13, SECTION 3 OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE (CONSTRUCTION BOARD OF APPEALS), was taken up on first reading by title only. 3

All members voting “Aye”. The Clerk read the ordinance by title only. Thomas Tracey, Construction Official, thanked the board members for volunteering their time. Following discussion and on motion made by Councilwoman McCartney and seconded by Councilwoman Spango, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on May 31, 2011. All members voting “Aye”. Ordinance #2321-11 On motion made by Councilwoman Spango and seconded by Councilman Krakoviak, AN ORDINANCE AMENDING AN ORDINANCE CREATING A RECLASSIFICATION AND SALARY SCHEDULE OF CERTAIN TOWNSHIP OF WEST ORANGE EMPLOYEES SETTING FORTH THEIR TITLES, CLASSIFICATION AND SALARY RANGES AND ADOPTING A SALARY GUIDE AND ESTABLISHING THE EMPLOYEE’S STATUS AS A TOWNSHIP EMPLOYEE AND UNDER THE GUIDELINES OF THE NEW JERSEY DEPARTMENT OF PERSONNEL, was taken up on first reading by title only. All members voting “Aye”. The Clerk read the ordinance by title only. On motion made by Councilwoman Spango and seconded by Councilman Krakoviak, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on May 31, 2011. All members voting “Aye”. Resolution #109-11 Resolution Authorizing a Contract with McEnerney, Brady & Co., LLC to Review the Township’s Length of Service Awards Program (LOSAP) as of December 31, 2010, in an Amount NTE $2,300 Following a lengthy discussion and on motion made by Councilman Krakoviak and seconded by Councilwoman Spango, the above mentioned resolution, as amended, was adopted. Resolution Authorizing the Continued Retention of Allied Risk Management Services from March 1, 2010 – February 28, 2011 as a Consultant to the Insurance Commission and Related Issues in an Amount NTE $20,000 Annually Following discussion and on motion made by Councilman Krakoviak and seconded by Councilwoman Spango, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #118-11 Resolution Authorizing an Executive Session to Discuss Litigation and Personnel On motion made by Councilman Krakoviak and seconded by Councilwoman Spango, the above mentioned resolution was adopted. All members voting “Aye”. On motion made by Councilman Krakoviak and seconded by Councilwoman Spango, the Council went into Executive session to discuss a Matter of Litigation and Personnel, specifically, Personnel- Health Department, Litigation-NJ DEP, et al. v. Occidental Chemical Corp., et al. and the Renna House All members voting “Aye”. The Minutes of this meeting are on file in the Office of the Municipal Clerk.
