Show all pagesZ:\Resolutions\2010\212-10 Northgrave Retention-Master Plan.DOC 212-10 August 17, 2010 RESOLUTION WHEREAS, Town of West Orange believes it is necessary and appropriate to appoint special counsel with regard to the 2010 Master Plan Reexamination Report and any potential litigation connected thereto; and WHEREAS, William W. Northgrave of the law firm McManimon and Scotland has substantial litigation, administrative and other experience; and WHEREAS, Mr. Northgrave has agreed to take this retention at an hourly rate of $175 up to a maximum of $7,500 in fees and expenses; and WHEREAS, McManimon & Scotland has been advised as to the Township’s Billing Guidelines and the requirement that bills be issued on a monthly basis; and WHEREAS, the engagement of William W. Northgrave of the law firm of McManimon and Scotland is a professional services contract which is exempt from public bidding requirements pursuant to N.J.S.A. 40A:11-5(1)(a)(i); and WHEREAS, the Chief Financial Officer of the Township has certified as to the availability of funds for this contract; NOW, BE IT HEREBY RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE that William W. Northgrave of the law firm of McManimon & Scotland shall be provided a professional service contract for special counsel services to be paid at the rate of $175 per hour up to a maximum of $7,500 subject to the Township's Billing Guidelines; and it is further RESOLVED, that the Municipal Clerk shall cause notice of this award to be published in accordance with law and available for inspection during normal business hours. ________________________________ Karen J.
