Hess, PE, PP, CME Planning Board Engineer Date: October 31, 2024 Re: Review of Ordinance 2870-24 Our File: 115.WRP0000.V01 CC: Geniece Gary-Adams - Zoning Official Zayibeth Carballo, PE, PLS, PP —- Municipal Engineer Diana McGovern, Esq. — Planning Board Attorney George Wheatle Williams, PP - Planning Board Planner In accordance with the Township's request, | have reviewed Ordinance 2870-24 which was introduced by the Governing Board on first reading at the September 10, 2024 Council meeting, This Ordinance will update the stormwater management requirements in Chapter 25, Section 29 of the Revised General Ordinances of the Township of West Orange based on the latest Stormwater Management Rules in N.J.A.C. 7:8 which was last amended by the New Jersey Department of Environmental Protection (NJDEP) on July 17, 2023. To assist each municipality to amend their Ordinance to comply with the latest NJDEP stormwater management rules, the NJDEP has provided a Model Stormwater Control Ordinance for Municipalities in Appendix D of the New Jersey Stormwater Management Best Management Practices Manual. In this regard, | have reviewed the proposed Ordinance for consistency with the model Ordinance and find that the only changes that have been made to the model Ordinance are those necessary to correct the section numbers to be consistent with the West Orange Code Book. Also, the references to the County recording office have been corrected to reference the County of Essex Register of Deeds and Mortgages. Based on the above, it is my professional opinion that Ordinance 2870-24 complies with the requirements set forth in N.J.A.C. 7:8 which was last amended on July 17, 2023.
