Jenkins was reviewed by the Nishuane Group, LLC. My responses and clarifications to the Review Letter by the Nishuane Group, LLC are as follows: Project Overview The emergency escape window is not part of this application and will be installed by others at a future date. In my discussion with Ms. Geniece Gary-Adams, Director of Planning & Development/Zoning Official on May 1, 2024 in her office, we agreed that although not stated explicitly in the Zoning Ordinance, the emergency escape window would be treated in the same vain as a fire escape (25-8.2.d) by which it would be permitted in a side yard because it is a life safety installation due to the configuration of the Lower Level basement area where a person would have a second means of egress from the proposed bedroom on that level. (See floor plan A-1) The West Orange Zoning Department would not have any objections, and the homeowner would be able to apply for a building permit. A. Roof Overhang The new addition located on the southeast corner of the house (17’-0” x 11’-0”) will encompass extra storage room as an extension of the garage for landscaping equipment, tools and a snowblower on the lower level and additional space for the Master Bedroom on the Upper Level of the residence for additional Wardrobe Storage. The new roof and it’s 3foot overhang is proposed to be consistent with the remainder of the residence, however the roof overhang on the south-east corner extends into the required setback by 2.6ft. 1 am allowed a 2ft.extension into the required 15-ft. side yard setback on the southern end of the house, thus a Variance is required. It is easier in my opinion to conceptualize and visualize the intent of the proposed work based on this interpretation of the zoning ordinance. B. Yard Encroachment — Heat Pump The proposed heat pump is not part of this application but will be designed and installed by others at a future date. It is also acknowledged thar pecific wording stating a heat pump is not noted in the ordinance, however, in the spirit of the ordinance, the heat pump, which is not attached to the house would extend into the required setback by 2’-6”. However, the size of the heat pump is shown on drawing A-2 for location review purposes on the northern side of the house. Further relief would be required on the northern end due to an existing side yard dimension to the property line of 8.33 feet which is non- conforming to the Ordinance where it requires that I have a 10ft. setback.
