ZONING BOARD OF ADJUSTMENT- TOWNSHIP OF WEST ORANGE NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE that the Zoning Board of Adjustment (“Board”) of the Township of West Orange, at a meeting to be held on November 21, 2024 at 8:00 p.m. will hold a public hearing by virtual format on the Zoom platform, on the application of Zinnia Health, LLC (“Applicant”) for zoning relief to operate a residential behavioral health facility for the treatment of mental health disorders and other co-occurring disorders such as substance abuse, with typical patient stays for 30-60 days, at property located at 33 Mt. Pleasant Avenue, Block 88, Lot 26 on the Township of West Orange Tax Map. Pursuant to N.J.S.A. 40:55D-70a, the Applicant is appealing from a determination dated August 15, 2024 by the Zoning Officer that this use is not a “hospital,” which is a permitted use under the Zoning Ordinance. In the event that the Board upholds the Zoning Officer’s determination, then the Applicant seeks a conditional use variance pursuant to N.J.S.A. 40:55D-70d(3), because the proposed use qualifies as a long-term residential health care facility, a permitted conditional use under the Zoning Ordinance, and the existing structure and property, for which no changes are proposed, do not comply with the conditions set forth in Ordinance Section 25-24.2B(1)(g), including (1) minimum lot area of 5 acres (2.181 acres existing); (2) minimum lot width of 350 feet (177 feet existing); (3) minimum front yard of 150 feet (22.5 feet existing); (4) minimum side front yard of 150 feet (less than 150 feet existing); (5) minimum side yard of 150 feet (8.7 feet and 23.7 feet existing); (6) minimum rear yard of 150 feet (less than 150 feet existing); (8) maximum building coverage of 25% (more than 25% existing); (9) maximum lot coverage of 35% (more than 35% existing); (10) minimum street frontage of 350 feet (177 feet existing). No exterior modifications are proposed. In the event that the Board determines that the use does not qualify as a permitted conditional use, then the Applicant seeks a use variance pursuant to N.J.S.A. 40:55D-70(d)(1).
