Court West Orange, NJ, 07052 PROPOSAL To the Members of the Zoning Board of Adjustment, | am submitting this application to respectfully request a variance to permit the construction of a deck at my residence. This deck would serve as the sole outdoor entertainment and recreation area for the property, enhancing its functionality, usability, and livability, while remaining aligned with the goals and intent of the local zoning regulations. Our home is situated on a corner lot with a notably narrow rear yard based on the shape of the property. Additionally, the rear yard exit from the first level of the home is elevated approximately four (4) feet three (3) inches above grade, creating challenges for ease of access. These unique characteristics significantly limit our ability to fully use and enjoy the rear yard in its current state. The property currently lacks any outdoor entertainment area, such as a patio or deck, further restricting its recreational and entertainment potential. The proposed deck would be largely screened from view by established evergreen trees and would face the driveway and side of the adjacent home at [5 Himsl Court], minimizing any visual or privacy impact on our immediate neighbor. It is my hope that you will recognize the proposed deck as a necessary and reasonable improvement to the property under the provisions and intent of The Revised General Ordinances of the Township of West Orange (adopted 6/26/2012). Physical and Use Changes Proposed: ¢ The proposed deck would be approximately 350 square feet in size. ¢ It would extend 14 feet from the house, including providing direct access to the backyard. ¢ Access to the deck would be from the existing sliding door (as is used today for the wooden stairs currently in place) conveniently located in the dining area off the kitchen. ¢ Given the absence of a designated outdoor entertainment area, this deck would provide an easily accessible and functional space for outdoor living, significantly enhancing our quality of life and the enjoyment of our property despite our narrow yard and elevated exit mentioned. Encroachment and Variance Details: 1. Per ordinance 25-8.2, unroofed terraces are not allowed to project more than eight (8) feet into the rear yard. 2. Justification for the Requested Variance: 1. Unique Circumstances and Hardship © The property’s configuration, including its shape and topographical features, has resulted in the absence of a functional and accessible outdoor space for recreation and entertainment, creating a practical hardship that significantly limits our use and enjoyment of the home. ¢ The proposed deck will address this deficiency by creating an accessible and well-structured outdoor space for recreation and entertainment—an essential feature commonly found in residential properties throughout the neighborhood. 2. Consistency with the Intent of Zoning Regulations © The proposed deck aligns with the purpose of the zoning ordinance, which aims to promote the health, safety, and general welfare of the community. e The design has been carefully planned to: © Maintain compatibility with the architectural character of the home and neighborhood. © Avoid undue encroachment on neighboring properties or infringement on their privacy. 3. Positive Impact on Property and Quality of Life © — Granting this variance will enhance the property’s functional and aesthetic value without negatively impacting the surrounding community. e Awell-designed deck will: o Improve the quality of life for my family and future homeowners by enabling outdoor recreation and entertainment. o Increase the property’s overall appeal and value, consistent with neighborhood standards. 4, No Substantial Detriment to Public Good ¢ The variance will not result in any substantial detriment to the public good or impair the zoning ordinance's intent. ¢ The deck’s construction will adhere to prevailing safety standards and respect the privacy and rights of neighboring property owners. ¢ Should this variance be granted, final drawings will be provided for approval as required and all required permits will be applied for, ensuring compliance with all Town requirements. In light of the above considerations, | respectfully request the Board’s favorable review and approval of this variance application.
