Promises by Grantor. The Grantor promises that except for casements, covenants and restrictions of record, the Grantor has done no act to encumber the Property. This promise is called a “covenant as to grantor's acts" (N.JLS.A. 46:4-6). This promise means that the Grantor has not allowed anyone else to obtain any legal rights which affect the Property (such as by making a mortgage or allowing a judgment to be entered against the Grantor). AND SUBJECT to the restriction that except in the event that the party of the first part or its affiliates shall again become a tenant or owner of the Property, the Property shall not be used directly or indirectly for the operation of a drug store or a so-called prescription pharmacy or prescription ordering, processing or delivery facility, whether or not a pharmacist is present at such facility, or for any other purpose requiring a qualified pharmacist or othér person authorized by law to dispense medicinal drugs, directly or indirectly, for a fee or.remuneration of any kind.
