-8- The negative criteria are fully satisfied The application can be approved without substantial detriment to the public good and without substantial impairment to the zone plan (the master plan) and the Zoning Ordinance based on the following: • The gambrel roof design results in the appearance of a one and one-half story building. • The proposed height and design is similar to the accessory building located in the rear of the property to the northeast as shown on page 1. • The protruding rear addition is being removed resulting in a rear setback of 4.65 feet is only 4.2 inches short of the required rear setback. • The removal of the rear addition will slightly reduce the amount of lot coverage. • Although the required rear yard is 40 feet by 30 feet or 1,200 sq. ft., the functional rear yard is 40 feet by 67 feet or 2,680 sq. ft. Consequently, the 499 sq. ft. accessory building coverage is less than 19% of the of the functional rear yard area which is well less than the 1/3 maximum. • Approval will result in an overall upgrade of the subject property and better assure its contribution as part of the residential neighborhood. • As a part-time home occupation, the duration of the requested use is more limited compared to a full-time home occupation.
