222-18 September 25, 2018 RESOLUTION AUTHORIZING THE EMERGENCY AWARD OF A NON-FAIR AND OPEN CONTRACT TO OMEGA ENVIRONMENTAL SERVICES, INC. WHEREAS, the Township of West Orange had a need to hire in an emergency, Omega Environmental, Inc. an environmental health and safety company, to do a Legionella assessment and water sampling as a non-fair and open contract pursuant to the provisions of N.J.S.A. 19:44A-20.5; and, WHEREAS, the Purchasing Agent has determined that the cost of these services will be over 17,500.00; and WHEREAS, the Township took a proactive position after learning an employee had contracted Legionnaires disease. Omega Environmental was immediately hired for the testing and assessment of eleven locations; and WHEREAS, these assessments required emergency contracts without quote with the Nephros Company to install infectious control filters on all water lines and Rocco Ciufalo Plumbing and Heating to assist with filter installation and various related work and remediation; WHEREAS, Omega Environmental, Inc. has completed and submitted a Business Entity Disclosure Certification which certifies that Omega Environmental, Inc. located at 280 Huyer Street, South Hackensack, NJ 07606 has not made any reportable contributions to a political or candidate committee in the Township of West Orange in the previous year and that contributions are prohibited through the term of the contract; and WHEREAS, the cost of these services with Omega Environmental, Inc. are $41,549.00 and the Township Chief Financial Officer has certified there are sufficient and available funds as required by N.J.A.C. 5:30-5.4. NOW THEREFORE, BE IT RESOLVED that the Township Council of the Township of West Orange authorizes the services of Omega Environmental, Inc. as described herein. BE IT FURTHER RESOLVED that the Business Disclosure Entity Certification be placed on file with this resolution. BE IT FURTHER RESOLVED that the Clerk shall publish such notice as required by law. This appointment was made without competitive bidding as professional services contract under the provision of the Local Public Contracts Law, as provided in N.J.S.A. 40A:11-5. Karen J.
