26-19 January 22, 2019 RESOLUTION WHEREAS, the Township of West Orange (the “Township”) is the owner of real property known as Block 170, Lots 13, 15.03 and 17 on the Tax Map of the Township commonly known as 590 Mt. Pleasant Avenue (the “Property”); and WHEREAS, the Township utilizes the Property as an integral part of its Recycling Program; and WHEREAS, the operations conducted at the Property include the composting of leaves, the processing of vegetative wood waste and operating a recycling convenience center for West Orange residents for mixed paper, cardboard, consumer electronics, tires, clean wood, and commingled containers; and WHEREAS, in 2013, the Township entered into an agreement with Reliable Wood Products, LLC (“Reliable Wood”) of 393 Lincoln Boulevard, Middlesex, New Jersey, 08846 for the operation of the Recycling Center for Class B materials, exempt wood, Class C materials, exempt compost and to operate the Recycling Center for the collection and processing of mixed paper, cardboard and commingled containers (the “Operations”) for a period of three (3) years with two (2) additional one year options, annexed hereto as Exhibit “A” (the “Agreement”); and WHEREAS, the Township authorized the two (2) additional one-year options; WHEREAS, on June 9, 2018, the Township advertised a Request for Proposal (“RFP”) entitled “Request for Proposal for Operation of the Township of West Orange Recycling Center” to award a new Contract to operate the West Orange Recycling Center (the “Contract”) following the expiration of the Agreement; and WHEREAS, on July 17, 2018, the Township received a single proposal from Reliable Wood (the “Proposal”), and WHEREAS, the Proposal contains certain exceptions and conditions to be examined and evaluated by the Township prior to a determination as to the award of the Contract, and WHEREAS, on or about September 4, 2018, the Township Council adopted Resolution 206-18 which authorized the Township to enter into an Temporary Extension
