39-20 February 18, 2020 RESOLUTION WHEREAS, the Township of West Orange (“Township”) is authorized to issue certain towing licenses for a period of three (3) years; and WHEREAS, on October 29, 2019, pursuant to Resolution 252-19, Select Towing Service, Inc. (“Select”), and Twin, Inc. T/A Twin Towing were awarded licenses; and WHEREAS, on or about December 6, 2019, Select informed the Township that they will no longer service the Township as of January 1, 2020; and WHEREAS, on or about January 22, 2020, the Township advertised a “Notice of Public Application Process for Municipal Towing Contracts,” pursuant to an application process under N.J.S.A. 40A:11-5(1)(u) and Township Code Section 5-32; and WHEREAS, full and complete applications with all required responsive materials were due from the applicants no later than February 11, 2020 (the “Application Deadline”); and WHEREAS, C & L Towing (“C&L”) was the only towing company that applied for a towing license to operate in the Township; and WHEREAS, pursuant to Township Code Section 5-32.4(b), after the Application Deadline, the Township Police Department reviewed and investigated the applicants and applications to determine whether the requirements of all applicable Township Code Sections were fully and completely satisfied, a copy of the Township Police Departments Towing License Application Investigation (the “Investigation”) is annexed hereto as Exhibit “A”; and WHEREAS, the Investigation concluded that C&L had satisfied the objective requirements of Township Code Section 5-32; and WHEREAS, N.J.S.A. 40A:11-5(1)(u) requires that all awards of towing contracts be made on “non-exclusionary and non-discriminatory terms and conditions,” which terms and
