CHAPTER 4, SECTION 33.1 SHALL BE AND HEREBY IS AMENDED AND SUPPLEMENTED TO INCORPORATE THE FOLLOWING: 4-33 SMOKE FREE KIDS ZONES. 4-33.1 Prohibition Against Smoking and Use of Tobacco or Cannabis Products. a. Smoking of cigarettes, including electronic cigarettes, the use of tobacco products, and the smoking or consumption of cannabis product within public parks, playgrounds, ballfields and schoolgrounds shall be prohibited within the Township of West Orange. b. Smoking of cigarettes, including electronic cigarettes, the use of tobacco products, and the smoking or consumption of cannabis product shall be prohibited within the Oskar Schindler Performing Arts Center located at 4 Boland Drive. IV. CHAPTER 12, SECTION 10 SHALL BE AND HEREBY IS AMENDED AND SUPPLEMENTED TO INCORPORATE THE FOLLOWING: 12-10 SMOKING PROHIBITED. It shall be unlawful for any person to:(i) smoke or carry lighted tobacco; (ii) utilize electronic cigarettes; or (iii) smoke or consume any cannabis product within any municipally-owned building. This section, however, shall not apply to any residential units within municipally- owned housing. Pursuant to N.J.S.A. 26:3D-62, a violation of this section act is subject to a fine of not less than $250 for the first offense, $500 for the second offense and $1,000 for each subsequent offense. V. REPEAL OF CONFLICTING ORDINANCES Any Ordinances of the Township which are in conflict with this Ordinance are hereby repealed to the extent of such conflict. VI. SEVERABILITY If any part of this Ordinance shall be deemed invalid, such parts shall be severed and the invalidity thereof shall not affect the remaining parts of this Ordinance. VII. EFFECTIVE DATE This Ordinance shall take effect upon final passage and publication in accordance with the law.
