Show all pages6431935-1 RESOLUTION WHEREAS, the Township of West Orange entered into a Developer’s Agreement dated August 12, 1997 with Shangol, Inc. which detailed certain obligations of the Developer with regard to Block 152.22, Lots 1412.01, 1412.04, 1412.10, 1413, 1424.20, 1424.21 and 1424.22 on the Tax Map of the Township; and WHEREAS, this Developer’s Agreement was recorded in the office of the Essex County Register on October 24, 1997 in Book 5501, pages 167 et seq.; and WHEREAS, the Township of West Orange entered into a Developers Agreement with Shangol, Inc. dated August 12, 1997, which Developer’s Agreement covers the same Block and Lots and which was recorded in the Office of the Essex County Register on December 9, 1997, in Book 5509. Pages 611, et seq.; and WHEREAS, on September 23, 2021, the West Orange Board of Adjustment granted site plan approval, with variances, to CSH Development to build an 85-unit 100 bed assisted living facility on the site, which approval was memorialized on October 21, 2021; and WHEREAS, CSH Development requires that the two Developer Agreements be discharged of record as to any provisions in the Developer Agreements that directly impact the Atrium development. Paragraph 25 and all other paragraphs mentioned or referenced in Paragraph 25 of both Developer Agreements shall remain in full force and effect as to the Township of West Orange and the County of Essex and are not impacted by this discharge. NOW THEREFORE IT IS RESOLVED that the Developer Agreements recorded in Essex County Deed Book 5501, Pages 167, et seq. and Deed Book 5509, Pages 611, et seq. be discharged of record and that the Mayor and Township Attorney are authorized to sign all necessary documents to carry out the discharges set out above; and
