167-22 June 28, 2022 RESOLUTION WHEREAS, on May 3, 2016, the Township of West Orange (the “Township”) adopted Resolution 121-16 appointing Matrix New World (“Matrix”), with offices at 26 Columbia Turnpike, Florham Park, New Jersey as the Licensed Site Remediation Professional (the “LSRP”) to assist and oversee the off-site vapor intrusion investigations on Central Avenue within the area designated the Central Valley Brownfield Development Area (the “BDA”) as to the suspected discharge of hazardous substances or hazardous waste; and WHEREAS, the property at 4-10 Central Avenue, Block 9, Lot 32 on the Township Tax Map (the “Biddleman Property”) was included in the BDA; and WHEREAS, the Department of Environmental Protection (“DEP”) has directed that additional vapor intrusion investigation occur with regard to six (6) properties (31 Mitchell Street; 33 Mitchell Street; 35 Mitchell Street; 41 Mitchell Street; 43 Mitchell Street; and 540 Valley Road); and WHEREAS, Matrix has submitted to the Township a proposal for the required work, annexed hereto as Exhibit “A;” and WHEREAS, the Proposal provides that Matrix will perform the required services, as set forth therein, for a total fixed fee cost not to exceed $62,900 which shall be subject to an application for a seventy-five (75%) percent reimbursement from the New Jersey Economic Development Authority (“EDA”); NOW, BE IT HEREBY RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, that the Township authorizes the retention of Matrix for the preparation and submission of off-site vapor intrusion investigations and related work pursuant to the Proposal annexed hereto as Exhibit “A;” and be it further
2 RESOLVED, that Mayor Robert D. Parisi is hereby authorized to execute any agreement or document required to effectuate the retention of Matrix consistent with the Proposal annexed hereto as Exhibit “A;” and be it further RESOLVED, that the Township Clerk is authorized to attest to the Mayor’s signature.
