206-13 October 29, 2013 R E S O L U T I O N WHEREAS, by Resolution No. 122-13 dated June 11, 2013 the Township awarded a contract entitled Ridgeway Park Site and Landscape Improvements to Scalora Brothers, Inc. T/A Scalora Landscaping, 382 Lackawanna Place, South Orange, New Jersey 07079 in the amount of $406,481.00; and WHEREAS, the site improvements included placing a new roof on top of four existing brick columns to restore a gazebo which previously existed on this site; and WHEREAS, during the course of construction Scalora Brothers, Inc. advised the Township Engineer and project designer Daniel Dowd of Barreto/Dowd that the four columns were not stable; and WHEREAS, upon inspection both the Township Engineer and Daniel Dowd of Barreto/Dowd concurred with the Scalora Brother’s findings; and WHEREAS, the Township Engineer suspects these columns were damaged during Hurricane Sandy; and WHEREAS, both Daniel Dowd of Barreto/Dowd and the Township Engineer recommend new tubular steel columns on new concrete footings be installed to support the roof, the brick columns be lowered to retain this architectural element and a new concrete slab be constructed as the base for the brick paver floor of the gazebo; and WHEREAS, the contractor submitted a not to exceed estimate of $25,000 to perform this additional work; and WHEREAS, the not to exceed estimate meets the approval of the Township Engineer and Daniel Dowd of Barreto/Dowd; and WHEREAS, the Township Engineer by letter dated October 23, 2013 recommends a Change Order be issued for this additional work to Scalora Brothers, Inc. in an amount not to exceed $25,000; and WHEREAS, the Township Engineer and Administration desire to perform this additional work; and

WHEREAS, the Township Council concurs in the foregoing. NOW THEREFORE BE IT RESOLVED, that Change Order No. 1 in the amount of $25,000 for additional work associated with constructing new tubular steel columns on new concrete footings along with a new concrete pad for the gazebo associated with the Ridgeway Park Site and Landscaping Improvements contracted to Scalora Brothers Inc., T/A Scalora Landscaping, 382 Lackawanna Place, South Orange, New Jersey 07079 be approved. BE IT FURTHER RESOLVED that the time to complete the project be extended from 120 days to 150 days or December 15, 2013. KAREN J.
