Terms & Conditions 1. Town ordinances and permit requirements are the owner’s responsibility. Any and all costs incurred by Rich Tree Service, Inc. due to the owner of property not adhering to town ordinances or permit requirements, will be paid by the owner to Rich Tree Service, 2. Customer is responsible for knowing all property lines. Rich Tree Service, Inc. will not be responsible for any trees removed or pruned on unauthorized properties. Customer will pay all charges including attorney fees, restoration, fines, and penalties incurred by Rich Tree Service, Inc. 3. The owner acknowledges that he/she or they is/are the owner of the property on which the noted work is to be done or that they have been authorized to sign this agreement for the property owner. 4. It is the customer’s responsibility to clearly mark any trees that are being removed with a one foot “x” in paint. Rich Tree Service, Inc. will not be responsible for cutting wrong trees. 5. Rich Tree Service, Inc. will provide Liability Insurance as well as Workmen’s Compensation Insurance for complete coverage of the work described therein. 6. Description of the job - right (R), left (L), center (C) is used when looking at the front of the house from the curb, unless otherwise noted. 7. The price quoted on contract is given when considering the easiest access to the area that the work is to be performed. Trucks and equipment may be driven on lawns, driveway, and other parts of the property unless otherwise noted on the contract. These areas will be protected when possible. When equipment & vehicles need to be on driveway/lawn area, Rich Tree Service, Inc. will not be responsible for damage to asphalt or lawn. 8. All stumps will be cut as low as possible, "flush cut". If stumps are ground, grindings will be left at the base of the tree. Stump grindings are not removed, unless otherwise noted on contract. 9. Customers must inspect pruning job prior to Rich Tree Service, Inc. leaving the site. If a return trip is necessary a charge will be billed on a time and material basis. 10. Any changes or alterations of the work and/or specifications agreed upon herein will call for an additional charge. 11. A signed contract authorizes work to be completed on the listed property. Rich Tree Service, Inc. will give 24 hours notice when viable. Due to weather conditions and other unforeseen circumstances, notice

UNFORESEEN CONTINGENCIES - Rich Tree Service, Inc. is not responsible for any damage that occurs to property or equipment due to underground utilities that are not marked out by NJ One Call or clearly marked by homeowner and noted on contract, such as, but not limited to, septic tanks, gas, lighting, electric, irrigation, invisible dog fences, etc. 13. No Price adjustment and/or reduction will be made for jobs that cannot be completed due to concrete, steel, fencing, etc. on or around trees stated on the contract. 14. When removing a fallen tree on top of a structure, Rich Tree Service, Inc. is not responsible for any additional damage that occurs during the removal of said tree. 15. When log is not removed off-site, logs 8” & larger in diameter will be cut to standard size, roughly 18”-24” and stacked at base of tree. Logs will not be split. When wood chips are requested to be left onsite, they will be dumped on the driveway or easily accessible area as noted on contract. Wood chips will not be spread, unless otherwise noted on the contract. 16. If township requires traffic control, an additional cost will ensue, unless otherwise noted on contract 17. Payment is due upon completion of the work – outstanding balances will incur a service charge of $30.00, as well as, a 2% service charge every 30 days. NJ Sales Tax is charged on all work performed, unless a valid NJ State Tax Exempt Form is presented by the customer. Sales Tax is in addition to the prices given. 18. Rich Tree Service, Inc. reserve the right to add an additional surcharge to payments made by credit or debit cards. 19. If the property owner does not make payment as set forth in this agreement and it becomes necessary for Rich Tree Service, Inc. to submit the matter for collection to an attorney, the owner of the property will be charged a collection fee of up to 50% of the total amount due. The owner will be responsible for any reasonable attorney's fees for collection of money owed. 20. Rich Tree Service, Inc. reserves the right to cancel any contract at any time. 21. A $40.00 returned check fee will be charged on all checks returned

YOU MAY CANCEL THIS CONTRACT AT ANY TIME BEFORE MIDNIGHT OF THE THIRD BUSINESS DAY AFTER RECEIVING A COPY OF THIS CONTRACT. IF YOU WISH TO CANCEL THIS CONTRACT, YOU MUST EITHER:1.)
