Ms. Zayibeth Carballo Township of West Orange Re: Professional Engineering Services Oskar Schindler Performing Arts Center and Crystal Lake Improvements October 24, 2024 Page 4 Flood Hazard Area Control Act Rules (FHA) The proposed improvements are near and within the regulated areas of the Crystal Lake. Crystal Lake is considered a FW2-NT water (according to the rules found within the Surface Water Quality standards found at N.J.A.C. 7:9B) and as a result will require a 50-foot riparian zone (as found at N.J.A.C. 7:13-4.1). Additionally, Crystal Lake is mapped as a FEMA Flood Zone A with no base flood elevations determined. Given the proposed improvements may take place within the riparian zone or within the flood hazard area, various Flood Hazard Area Permits may be required including but not limited to, Permit-by-Rules, General Permits, or an Individual Permit. If the project is considered a major development in terms of stormwater, as in there will be more than 1 acre of ground disturbance or more than ¼ acre of new impervious surface, an Individual Permit will be required. Once the concept plan is developed, the specific permits required will be identified and discussed with the NJDEP during a pre-application meeting. Based on a preliminary review of USGS StreamStats, Crystal Lake appears to drain less than 50 acres and therefore would not have a flood hazard area associated with it (in accordance with N.J.A.C. 7:13-2.3). CME will confirm these findings and discuss with the NJDEP during the pre-application meeting. CME will prepare and submit all required information for a NJDEP Permit application based on the final design. This includes preparing public notices, an Environmental Report demonstrating compliance with the regulations, permit plans, and a stormwater/design report where necessary. It is understood that the permit fees are the responsibility of the Township. Freshwater Wetland Protection Act Rules While freshwater wetlands are not mapped on site, it is probable that wetlands will exist within the vicinity of Crystal Lake. As such, a site visit will be conducted to confirm these findings. If wetlands are identified in the area, it is likely that the wetlands will be considered intermediate resource value and require a 50-foot transition area (as found at N.J.A.C. 7:7A-3.3(d)).
