190-12 October 2, 2012 RESOLUTION WHEREAS, the Township of West Orange (the “Township”) is the owner of real property known as Block 170, Lots 13, 15.03 and 17 on the Tax Map of the Township commonly known as 590 Mt. Pleasant Avenue; and WHEREAS, the Township utilizes this property as an integral part of its Recycling Program; and WHEREAS, the operations conducted here include the composting of leaves, the processing of vegetative wood waste and operating a recycling convenience center for West Orange residents for mixed paper, cardboard, and commingled containers; and WHEREAS, the Township requires the services of a firm to operate the Recycling Center for Class B materials, exempt wood, Class C materials, exempt compost and to operate the Recycling Center for mixed paper, cardboard and commingled containers; and WHEREAS, in July 2008, the Township utilizing the competitive contracting provisions of the Local Public Contracts Law, N.J.S.A. 40A:11-4.1 through 4.5, advertised a Request for Proposal (“RFP”) entitled “Operation of the Township of West Orange Recycling Center for Class B, Exempt Woods, Class C Exempt Compost Operation and the Recycling Convenience Center” in order to enter into a Contract to operate the West Orange Recycling Center (the “Contract”) and WHEREAS, the RFP sought proposals for a term of three (3) years with two (2) one- year options; and WHEREAS, the Township received a single proposal in response to the RFP from Reliable Wood Products, LLC (“Reliable Wood”) of One Caven Point Road, Jersey City, New Jersey, 07305, a copy of the proposal is annexed hereto as Attachment “A;” and WHEREAS, the Director of Public Works determined that Reliable Wood’s proposal
was responsive and compliant to the specifications contained within the Township’s RFP; and WHEREAS, an evaluation committee was formed to review and discuss the Proposal submitted by Reliable Wood and each members was tasked with individually evaluating the Proposal based on the criteria in the RFP; and WHEREAS, following the recommendation of the evaluation committee to award the Contract to Reliable Wood and the Business Administrator’s concurrence with the evaluation committee’s recommendations, the Township Council issued a resolution awarding the Contract to Reliable Wood, annexed hereto as Attachment “B,” and WHEREAS, Reliable Wood and the Township executed a Management, Operation and Maintenance Service Agreement for the West Orange Recycling Center and Composting Facility, annexed hereto as Attachment “C;” and WHEREAS, the Contract provided that Reliable Wood would pay rent in the amount of $7,500 per month ($90,000 per year) to the Township; and WHEREAS, the Contract commenced on October 1, 2008; and WHEREAS, the initial term of the Contract is set to expire on or about September 30, 2012; and WHEREAS, Reliable Wood has generally performed in a satisfactory manner and should continue for an additional one year extension as set forth in the Contract.
NOW, BE IT HEREBY RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE that the Mayor is hereby authorized to issue a one-year extension to Reliable Wood as set forth in the Contract under the terms set forth in the Contract and proposal submitted by Reliable Wood. 183-12 October 2, 2012 RESOLUTION WHEREAS, the Township of West Orange Housing Rehabilitation Program has a mortgage against certain real property owned by Yolette Adolphe (the “Owner”) residing at 29 Joyce Street, Block 11, Lot 9 (the “Property”), in the amount of Fourteen Thousand and Two-Hundred Dollars ($14,200.00), which was dated August 21, 2007 and recorded in the Essex County Register’s Office on August 24, 2007 in Mortgage Book 12082, Page 8492 (the “WOHRP Mortgage”); and WHEREAS, there is a first mortgage on the Property from MetLife Home Loan in the outstanding amount of Ninety-Seven Thousand, Nine-Hundred and Twelve Dollars, and Four cents ($97,912.04) (“First Mor tgage”); and WHEREAS, the Owner desires to refinance her home and obtain a new mortgage loan from J.P. Morgan Chase, in an amount not to exceed One Hundred and Twenty-Nine Thousand, Eight-Hundred and Seventy-Seven Dollars ($129,877.00), and at a lower interest rate than the Current Mortgage (the “New Mortgage”); and WHEREAS, the New Mortgage will pay off the First Mortgage; and WHEREAS, the Owner has requested that the Township of West Orange subordinate the WOHRP Mortgage to the New Mortgage; and WHEREAS, the Owner has provided an appraisal indicating that the appraised fair market value of the Property is approximately One Hundred and Seventy-Seven Thousand Dollars ($177,000.00); and WHEREAS, the Owner has requested that the Township of West Orange subordinate its mortgage to the New Mortgage; and WHEREAS, based on the appraisal submitted and the amount of the New Mortgage, the proposed subordination will not change the equity available to satisfy the WOHRP Mortgage; NOW THEREFORE, BE IT RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, that the Mayor be and hereby is authorized to execute a Subordination of Mortgage in favor of J.P. Morgan Chase with respect to the Property and the Owner; and be it further RESOLVED, that the Municipal Clerk be and is hereby authorized to attest to the Mayor’s signature on the Subordination of Mortgage. 186-12 October 2, 2012 RESOLUTION WHEREAS , THE 2012 EXTENDED DUPLICATE HAD CHANGES IN THE ASSESSMENT VALUE FOR CERTAIN PROPERTIES WITHIN THE TOWNSHIP THAT WERE DECREASED CONSISTENT TO THAT OF THE TAX ASSESSOR; AND WHEREAS , THE 2012 EXTENDED DUPLICATE HAD CHANGES IN THE CLASS OF CERTAIN PROPERTIES WITHIN THE TOWNSHIP THAT WERE TAXABLE TO EXEMPT, CONSISTENT TO THAT OF THE TAX ASSESSOR; AND WHEREAS , CERTAIN TOWNSHIP PROPERTY OWNERS ARE ENTITLED TO A REFUND FOR THE OVERPAYMENT OF THEIR 2012 REAL ESTATE TAXES; AND WHEREAS , THE TAX COLLECTOR OF THE TOWNSHIP OF WEST ORANGE HAS INDICATED THAT SUCH TAXPAYERS ARE ENTITLED TO REFUNDS TO THE EXTENT OF SUCH OVERPAY-PAYMENTS; NOW, THEREFORE BE IT RESOLVED , BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE THAT THE TAX COLLECTOR AND TREASURER OF WEST ORANGE ARE AND THEY ARE HEREBY AUTHORIZED, EMPOWERED AND DIRECTED TO CAUSE TO BE PAID TO SUCH TAXPAYERS THE SUMS INDICATED IN FULL AND FINAL SATISFACTION OF OVERPAYMENT OF THE 2012 TAXES.
