224-12 December 4, 2012 RESOLUTION AUTHORIZING THE COLLECTOR OF TAXES TO REBATE PAYMENT TO THE LISTED TAXPAYER PURSUANT TO FINAL JUDGMENT BY THE TAX COURT OF NEW JERSEY WHEREAS, final judgment on tax appeals has been rendered by the Tax Court of New Jersey on the petitions of the taxpayer listed on the attached schedule reducing the assessment for the year 2009, 2010, and 2011. 225-12 December 4, 2012 RESOLUTION Cancelling Delinquent Sewer Charges less than $2.00 WHEREAS, N.J.S.A. 40A:5-17 allows for the cancellation of 2012 annual sewer charges delinquent in the amounts of less than $2.00; and, WHEREAS, the governing body may authorize the Tax Collector to process, without further action on their part, any cancellation of 2012 annual sewer charges of delinquencies of less than $2.00. NOW THEREFORE, BE IT RESOLVED, that the Governing Body of the Township of West Orange, County of Essex, State of New Jersey, hereby authorize the Tax Collector to cancel said sewer amounts as deemed necessary. BE IT FURTHER RESOLVED, that a certified copy of the Resolution be forwarded to the Tax Collector, the Chief Financial Officer and the Municipal Auditor. Karen J. 226-12 December 4, 2012 RESOLUTION This resolution is to set the interest rate and penalties to be charged for delinquent tax payments. WHEREAS, pursuant to N.J.S.A. 43:4-67, the Township Council of the Township of West Orange has passed a resolution fixing the rate of interest to be charged for non-payment of Tax or Assessments; and WHEREAS, the Township Council of the Township of West Orange now desires to set the calendar year 2013 rate of interest and penalties to be charged taxpayers who are delinquent in the payment of taxes and assessments due and owing; NOW, THEREFORE BE IT HEREBY RESOLVED by the Township Council of the Township of West Orange that the rate of interest and/or penalty to be charged for the non- payment of taxes and/or assessments for when they become delinquent for the calendar year 201 3 as follows: a. No interest shall be charged if payment of any installment is made within the tenth (10th) calendar day following the date upon which the same become payable. If the tenth day falls on a weekend or Municipally Observed Holiday, the grace period shall be extended until the next working day. b. Upon the expiration of the tenth (10th) day as aforesaid, the rate of interest shall be Eight Percent (8%) per annum of the first $1,500.00 of said delinquency and Eighteen Percent (18%) per annum on any amount in the excess of $1,500.00, which is to be calculated from the date the tax was payable through and inclusive of the date of actual payment. c. An additional Six percent (6%) penalty for delinquencies in excess of $10,000.00 remaining unpaid at the end of the calendar year. BE IT FURTHER RESOLVED that the charges on account of delinquent properties as 1

227-12 December 4, 2012 RESOLUTION WHEREAS, the Mayor and Council of the Township of West Orange have been advised of the proposed settlement of a Tax Appeal filed on behalf of Blackburn Development under Docket Nos.: 003949-2007, 001621-2008, 001420 -2009, 005272-2010 and 009827-2011 and 003425-2012, and WHEREAS, the said Governing Body has been advised as to the merits of the subject Tax Appeals by legal counsel, expert appraisal personnel hired by the Township as well as the Township Tax Assessor; and WHEREAS, the proposed Tax Appeals settlement components are as set forth in Schedule “A” attached hereto and made a part hereof; and WHEREAS, it is in the best interest of the Township of West Orange to settle the subject Tax Appeals in accordance with the settlement proposal set forth hereinabove. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of West Orange that settlement of the said Tax Appeals be finalized in accordance with Schedule “A” attached and with respect to same, the Mayor, Borough Clerk and/or any other appropriate official is hereby authorized to perform any act in order to effectuate the purposes set forth in this Resolution. BE IT FURTHER RESOLVED that the Certificate of Availability of Funds pursuant to N.J.S.A. 40A:4-57 has been certified to by the Chief Finance Officer and is attached hereto and made a part hereof.
