228-12 December 4, 2012 RESOLUTION WHEREAS, the Mayor and Council of the Township of West Orange have been advised of the proposed settlement of a Tax Appeal filed on behalf of West Orange under Docket Nos.: 007054-2008, 000404-2009 for the years 2008 and 2009, and filed on behalf of West Orange Plaza, the owner of the property located at the intersection of Eagle Rock Avenue and Prospect Avenue, under Docket Nos.: 001069-2010, 010998-2011 and 001219-2012 for years 2010, 2011, and 2012 and WHEREAS, the said Governing Body has been advised as to the merits of the subject Tax Appeals by legal counsel, expert appraisal personnel hired by the Township as well as the Township Tax Assessor; and WHEREAS, the proposed Tax Appeals settlement components are as set forth in Schedule “A” attached hereto and made a part hereof; and WHEREAS, pursuant to Resolution No. 90-08 passed by the Township Council on April 8,2008, the Township retained Blau & Blau to pursue a tax appeal concerning the under assessment of Block 152.24, Lots 1445 and 1445.05 (the “Property”) which retention was on a one-third (1/3) contingency basis; and WHEREAS, it is in the best interest of the Township of West Orange to settle the subject Tax Appeals in accordance with the settlement proposal set forth hereinabove. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of West Orange that settlement of the said Tax Appeals be finalized in accordance with Schedule “A” attached and with respect to same, the Mayor, Municipal Clerk and/or any other appropriate official is hereby authorized to perform any act in order to effectuate the purposes set forth in this Resolution. BE IT FURTHER RESOLVED that the Certificate of Availability of Funds pursuant to N.J.S.A. 40A:4-57 has been certified to by the Chief Finance Officer and is attached hereto and made a part hereof. 230-12 December 4, 2012 RESOLUTION TO HOLD A CLOSED SESSION WHEREAS, the Open Public Meetings Act (N.J.S.A. 10:4. et seq.) provides for the exclusion of the public meetings of the governing body during the discussion of certain matters; and WHEREAS, prior to the exclusion of the public from a meeting of the Township Council it is required that the Council adopt a Resolution stating the general nature of the subject to be discussed and stating as precisely as possible the time when the minutes of the discussion conducted in closed session can be disclosed to the public; and WHEREAS, this body is about to consider a matter which falls within the purview of N.J.S.A. 10 -4-12, and can properly exclude the public from such discussions; now, therefore, be it BE IT RESOLVED, that the Township Council of the Township of West Orange, now assembled in public session at its regular meeting of November 27, 2012 shall enter into a closed session to consider the following matter(s). () 1. Discussion of any material, the disclosure of which constitutes an invasion of individual privacy. () 2. A collective bargaining agreement or the terms of provisions of same. () 3. Techniques or tactic utilized to protect the safety and property of the public provided that their disclosure could impair such protection. () 4. IT IS FURTHER RESOLVED, that the minutes of said discussion shall be made public as soon as the matter under discussion is no longer of a confidential or sensitive nature such that the public interest will no longer be served by such confidentiality. 2365-12 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7-32.2, RESTRICTED PARKING ZONES, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE BE IT ORDAINED, by the Township Council of the Township of West Orange, in the County of Essex, State of New Jersey as follows: Section 1. Subsection 7-32.2, Restricted Parking Zones, of the Revised General Ordinances of the Township of West Orange is hereby supplemented and amended as follows ( italic type denotes deletion, bold type denotes addition): 7-32.2 Restricted Parking Zones. Pursuant to N.J.S.A 39:4-197.6, Restricted Parking Zones, as defined in N.J.S.A. 39:4-207.6e, are established in front of the following residences as indicated on the Tax Maps of the Township of West Orange, at the specified locations. Parking within a specific zone is restricted to the motor vehicle issued a permit pursuant to N.J.S.A. 39:4 -197.7. In accordance with N.J.S.A., 39:4-197.6 parking is permitted in the Restricted Parking Zone except when prohibited in front of the residence by other sections of this Chapter.
