Pursuant to NJAC 7:13-2.3(b), a flood hazard area exists along every regulated water that has a drainage area of 50 acres or greater. If a regulated water has a drainage area of less than 50 acres, the water does not possess a flood hazard area that is regulated under this chapter. Based upon the documentation attached to the RFP, and our independent review, the Crystal Lake has a drainage area of approximately 23 acres. Therefore, Flood Hazard Area permitting relating to flood hazard areas is not anticipated, or included in this proposal. However, it is acknowledged that permitting will be required for disturbance in the Riparian Zone. 2. Crystal Lake is tributary to the Rahway River. Pursuant to NJAC 7:9B-1.15(f), the Rahway River is not a Category One Water. Therefore, design considerations, including mitigation, for Category One Waters are not anticipated or included in this proposal. 3.
