ARTICLE 13 —- CLOTHING ALLOWANCE Section |. Increase annual clothing allowance from $900 to: 2024: $950 per year 2025: $1,000-per year 2026, 2027, and 2028: $1,050 per year ARTICLE 16 — GRIEVANCE PROCEDURE Clarify #2: After “Civil Service Commission” add the phrase “as major discipline.” Clarify #4c: Replace State Board of Mediation with reference to PERC selection process. Modify #5 as follows: ¢ Replace 1* paragraph with: Charges or complaints against any member of the Police Department shall be investigated pursuant to New Jersey Attorney General Guidelines on Internal Affairs. * Revise subpart b to add: Any adverse decision on minor discipline may be submitted to arbitration by the Union pursuant to 4c. ARTICLE 20 - BASE SALARY Section 1, Annual across-the-board salary increases for 2024 through 2028 shall be effective (and retroactive) as follows: January 1, 2024: 1.5% July 1, 2024: 1.5% January 1, 2025: 3.0% January 1, 2026: 3.0% January 1, 2027: 3.0% January 1, 2028: 3.0% The Salary Guide shall be attached. Section 3: Subparagraph A through E shall be replaced with the following: "A. All members of the bargaining unit shall receive a $4,500 annual allowance as part of their pensionable base salary in 2024. Said allowance annual it
allowance shall be increased to $5,000 for years 2025, 2026,2027 and 2028." Existing subparagraph F shall be re-labeled "B". Section 5; Revise to add the following: A bi-monthly payroll may be implemented provided that: (1} the Township provides the SOA at least sixty (60) days’ advance notice; (2) same is implemented in January of a given contract year; and (3) the Township tenders each member's annual salary in full for the calendar year immediately preceding the switch to a bi-monthly payroll. Section 6 (new}. The parties’ existing Longevity pay entitlement, which shall be payable upon the member's completion of the years set forth below, shall be codified as follows: Near 5: 2% Year 10: 4% (Year 15: 6% Year 20: 8% Year 24: 10% ARTICLE 21 — HEALTH BENEFITS Sections 4, 5, and 6. |dentify specific Aetna Health Plan; Prescription Plan and Dental Plan and attach summary of coverage for each plan as appendices. Section 7. Revise current text to replace all references to “signing of this agreement” with “February 15, 2022” as applicable. ARTICLE 23 - SCHOOLING Effective January 1, 2025 replace current annual $400 (Associates) and $800 (Bachelors) lump sum allowances payable each August by: (1) expressly identifying the below dollar amounts payable to members possessing the applicable degree(s); and (2) distributing same on a prorated basis each pay period along with base salary. Said payment shall be applicable to any such Degree, not just police administration, from an accredited institution of higher learning and

365-24 December 10, 2024 RESOLUTION APPROVING MEMORANDUM OF AGREEMENT BETWEEN THE WEST ORANGE FIREFIGHTERS’ MUTUAL BENEVOLENT ASSOCIATION, LOCAL 28 (“FMBA”) AND THE TOWNSHIP OF WEST ORANGE WHEREAS, the Township of West Orange (“Township”) and The West Orange Firefighters Mutual Benevolent Association, Local 28 (“FMBA”) have an existing Collective Bargaining Agreement; and WHEREAS, the existing Collective Bargaining Agreement expired on December 31, 2023; and WHEREAS, the township and FMBA have negotiated in good faith; and WHEREAS, on or about December 4, 2024, the Township and FMBA entered into a Memorandum of Agreement containing the terms for a new Collective Bargaining Agreement for the Period of January 2024 through December 31, 2028; and WHEREAS, James P. Abbott, Interim Business Administrator, executed the Memorandum of Agreement subject to the Township Council’s consideration and approval; and WHEREAS, upon formal approval, it is anticipated that a formal Collective Bargaining Agreement will be drafted and executed between the parties; NOW, BE IT HEREBY RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, that the Memorandum of Agreement dated December 4, 2024 between FMBA, and the Township annexed hereto as Exhibit “A,” be and is hereby approved, and be it further RESOLVED, that the Township Clerk shall make available during normal business hours the annexed Memorandum of Agreement subject to the terms and conditions set forth in a formal agreement. 365-24 MEMORANDUM OF AGREEMENT BETWEEN TOWNSHIP OF WEST ORANGE AND THE WEST ORANGE FIREFIGHTERS MUTUAL BENEVOLENT ASSOCIATION, LOCAL NO. 28 (“FMBA”) The TOWNSHIP OF WEST ORANGE (“TOWNSHIP”) and WEST ORANGE FIREFIGHTERS MUTUAL BENEVOLENT ASSOCIATION, LOCAL NO. 28 (“FMBA”) hereby agree to recommend for ratification and approval the following for a new contract between the TOWNSHIP and FMBA for the period from January 1, 2024 to December 31, 2028: 1. DURATION: January 1, 2024 to December 31, 2028. 2. ARTICLE 9, Salaries: January 1, 2024 - 1.5%; July 1, 2024 — 1.5%; January 1,2025- 3%; January 1, 2026 — 3%; January 1, 2027 -— 3%; and January 1, 2028 — 3%. Amend Paragraph B to provide that the Township shall be able to move to a semi- monthly payroll at its discretion. Amend Paragraph E to provide that effective 2025, the EMT stipend shall be increased by $500 to a total of $5,000. In the event that the Township agrees to a higher salary increase with another bargaining unit during the term of this agreement, the parties agree to meet for the purpose of negotiating the same increase for the FMBA. 3. ARTICLE 11, Scholastic Credit Compensation: Amend to provide that permanent regular members of the Fire Department who obtain a bachelor’s degree from an accredited institution of higher learning shall be entitled to receive, in any calendar year, eight hundred dollars ($800.00) upon proof of obtaining a degree submitted to the Business Administrator. Compensation shall no longer be offered for credits less than a full degree. 4. ARTICLE 14, Sick Leave: Amend the Article to add the following: “Pursuant to N.J.S.A. 11A;6-19.2, Employees hired on or after May 21, 2010 shall be entitled to payment for sick leave under this Article of up to a maximum of $15,000 and only upon retirement from a pension system.”
5. ARTICLE 24, Uniform Allowance: a. Unform allowance for all West Orange Firefighters shall be increased as follows: i, 2025 - $850 ii, 2026 - $900 iii. 2027 - $950 iv. 2028 - $1,000 b. The Township shall replace, at its own expense, any clothing and equipment which may be damaged in the performance of duty, provided that said damage was not the result of the member’s abuse, misuse, or gross negligence. The terms of this MOA are subject to ratification by the FMBA and the approval of the Council of the TOWNSHIP OF WEST ORANGE. All prior agreements and all other provisions of the Parties’ existing collective bargaining agreement not modified by this MOA shall remain in effect and otherwise unchanged. All issues not included in this MOA shall be considered withdrawn. EN 366-24 2024-2028 MEMORANDUM OF AGREEMENT BY AND BETWEEN THE TOWNSHIP OF WEST ORANGE AND WEST ORANGE FIRE SUPERIOR OFFICERS ASSOCIATION WHEREAS, the Township of West Orange (Township) and the West Orange Fire Superior Officers Association (SOA) are parties to a series of successive collective negotiations agreements (CNAs), the most recent of which covered the period of January 1, 2018 through December 31, 2023; WHEREAS, the parties have engaged in good faith negotiations re the terms of a successor collective negotiations agreement for the years 2024 through 2028; WHEREAS, the parties have agreed upon the terms and conditions set forth below, subject to the ratification by the SOA’s membership as well as the Township’s Governing Body; WHEREAS, all terms set forth below shall be retroactive to January 1, 2024 unless otherwise stipulated below. Moreover, again unless otherwise stipulated below, the terms set forth herein shall apply to any member who retired on or after January 1, 2024 and prior to the ratification of this Agreement by both parties. Lastly, all terms set forth in the parties’ 2018 - 2023 CNA shall be retained, unchanged, in the successor agreement unless otherwise stipulated below. NOW, THEREFORE BE !T RESOLVED, the parties tentatively agree as follows: DURATION. Five (5) years: January 1,2024 through December 31, 2028. ARTICLE VIII — SALARIES (pg. 10). Paragraph A. The first two sentences shall be revised as follows: “Qpon promotion to any Officer's Rank, the individual shall go to minimum salary for that rank. !f said promotion occurred prior to September 1*, he/she shall progress to maximum on the following January 1%. If said promotion occurred on or after September 1, he/she shall progress to maximum on their first anniversary date.” Annual across-the-board salary increases 2024 through 2028 shall be as follows: January 1, 2024: 1.5% July 1, 2024: 1.5% January 1, 2025: 3.0% January 1, 2026: 3.0% January 1, 2027: 3.0% January 1, 2028: 3.0% Effective January 1, 2025, annual Inspector Stipend, to be distributed as part of base pay, and contingent upon said member maintaining his/her license: $500.

ARTICLE IX — SCHOLASTIC CREDIT COMPENSATION (pg. 13). New Paragraph C. The following clause shall be added to this paragraph: 6. Effective January 1, 2025, Article IX, Section A shall no longer be applicable. Instead, permanent regular members of the uniformed Fire Department possessing a Bachelor’s Degree in any field of study from an accredited institution shall be entitled to receive $1,200 annually after submitting proof of said Bachelor’s Degree to the Business Administrator. Said lump sum compensation shail be tendered annually each August. ARTICLE X - OVERTIME (pg. 15). The following shall be added to the second paragraph: “Effective January 1, 2025, once a member's compensatory time bank reaches three hundred fifty (350) hours in a given calendar year, the Chief may disapprove any further accumulation of compensatory time for the remainder of said calendar year. The aforementioned three hundred fifty (350) hours shall not include or otherwise apply to compensatory time earned for attendance at any Department-approved training.” ARTICLE Xi ~ VACATIONS (pg. 8). Paragraph 8(7). This paragraph shall be revised as follows: “As per N.J.A.C. 4A:6-1.2, vacation leave not used in a calendar year because of Business necessity shall be used during the next succeeding year only except as otherwise provided by law.” ARTICLE Xill — SICK LEAVE (pg. 20). Subparagraph 3 shall be added and shall state as follows: “Notwithstanding the above, payments to fire superior officers hired on or after May 21, 2010, shall only be payable upon retirement and shall not exceed $15,000.” ARTICLE XIV — INJURY AND ILLNESS LEAVE (pg. 21). The existing text in this article shall be revised as follows: “In the event a member is injured or becomes ill on duty or as a result of performance of his or her duties while off duty and is unable to report for duty, the Township shall compensate said member 100% of
