event a member is injured or becomes ill on duty or as a result of performance of his or her duties while off duty and is unable to report for duty, the Township shall compensate said member 100% of his/her compensation, inclusive of stipends, and other benefits for up to one (1) year or until said member is cleared for return to duty, whichever event occurs first. No paid leave shall be deducted from the member's accrued paid leave as a result of his/her absence.

i 1 | | | i i It is understood that any injury, illness, exposure or incident shall be compensable under this provision when same would qualify the member for temporary Workers Compensation benefits. It is further understood that any amount received by the member in temporary Workers Compensation benefits shall be credited against the amount paid by the Township so the member is at 100% of compensation. This does not affect any permanent Workers Compensation award/benefit. In the event there is an initial dispute about the eligibility for temporary Workers Compensation benefits the member shall receive injury on duty payments set forth above until there is a determination that such absence is not eligible for Workers Compensation benefits at which time injury on duty benefits will prospectively cease and shall not be reinstated unless the determination is later revised; and, if such determination is reversed reimbursement to the member shall be retroactive to date of initial rescission, unless otherwise stated.” ARTICLE XX ~ GRIEVANCE PROCEDURE (pg. 30): Moving forward from this MOA, the parties shall submit to the Public Employment Relations Commission for Arbitration instead of the New Jersey State Board of Mediation. Revise to replace references to NJSBM with PERC. ARTICLE XXVIII - UNIFORM ALLOWANCE (pg. 40). The annual uniform allowance shall be increased as follows: 2024 $850 2025 $900 2026 $950 2027 & 2028 $1,000 Also, the Township shall be obligated to replace, at its own expense, any clothing and equipment which may be damaged in the performance of duty, provided that said damage was not the result of the member’s abuse, misuse or gross negligence. 367-24 December 10, 2024 RESOLUTION APPROVING MEMORANDUM OF AGREEMENT BETWEEN TEAMSTERS LOCAL 560, PUBLIC SAFETY TELECOMMUNICATION OPERATORS AND THE TOWNSHIP OF WEST ORANGE WHEREAS, the Township of West Orange (“Township”) and Teamsters Local 560, Public Safety Telecommunication Operators, have an existing Collective Bargaining Agreement; and WHEREAS, the existing Collective Bargaining Agreement expired on December 31, 2023; and WHEREAS, the township and Teamsters Local 560, Public Safety Telecommunication Operators have negotiated in good faith; and WHEREAS, on or about December 4, 2024, the Township and Teamsters Local 560, Public Safety Telecommunication Operators entered into a Memorandum of Agreement containing the terms for a new Collective Bargaining Agreement for the Period of January 1, 2024 through December 31, 2028; and WHEREAS, James P. Abbott, Interim Business Administrator, executed the Memorandum of Agreement subject to the Township Council’s consideration and approval; and WHEREAS, upon formal approval, it is anticipated that a formal Collective Bargaining Agreement will be drafted and executed between the parties; NOW, BE IT HEREBY RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, that the Memorandum of Agreement dated December 4, 2024 between Teamsters Local 560, Public Safety Telecommunication Operators and the Township of West Orange, annexed hereto as Exhibit “A,” be and is hereby approved, and be it further RESOLVED, that the Township Clerk shall make available during normal business hours the annexed Memorandum of Agreement subject to the terms and conditions set forth in a formal agreement. 367-24 MEMORANDUM OF AGREEMENT BETWEEN TOWNSHIP OF WEST ORANGE AND THE INTERNATIONAL BROTHERHOOD OF TEAMSTERS LOCAL 560 COMMUNICATIONS PERSONNEL (“IBT”) The TOWNSHIP OF WEST ORANGE (“TOWNSHIP”) and INTERNATIONAL BROTHERHOOD OF TEAMSTERS LOCAL 560 COMMUNICATIONS PERSONNEL (“IBT”) hereby agree to recommend for ratification and approval the following for a new contract between the TOWNSHIP and IBT for the period from January 1, 2024 to December 31, 2028: 1, DURATION: January 1, 2024 to December 31, 2028. 2. ARTICLE XVIL, WAGES: January 1,2024- 1.5%; July 1, 2024 ~ 1.5%; January 1, 2025 — 3%; January 1, 2026 — 3%; January 1, 2027 — 3%; and January 1,2028- 3%. 3. ARTICLE IX, CLOTHING - Effective January 1, 2025, the clothing allowance shall be increased to one thousand dollars ($1,000.00) per year for all bargaining unit employees. The terms of this MOA are subject to ratification by the IBT and the approval of the Council of the TOWNSHIP OF WEST ORANGE. All prior agreements and all other provisions of the Parties’ existing collective bargaining agreement not modified by this MOA shall remain in effect and otherwise unchanged. TOWNSHIP OF WEST ORANGE ORDINANCE NUMBER 2881-24 ORDINANCE OF THE TOWNSHIP OF WEST ORANGE, IN THE COUNTY OF ESSEX, STATE OF NEW JERSEY PROVIDING FOR A SPECIAL EMERGENCY APPROPRIATION IN AN AMOUNT NOT TO EXCEED $1,800,000 TO FUND CONTRACTUALLY REQUIRED SEVERANCE LIABILITIES RESULTING FROM THE RETIREMENT OF EMPLOYEES IN THE TOWNSHIP WHEREAS, N.J.S.A. 40A:4-53h provides that a local unit such as the Township of West Orange, in the County of Essex, State of New Jersey (the “Township”), may adopt an ordinance authorizing a special emergency appropriation for the payoff of contractually required severance liabilities resulting from the layoff or retirement of employees of the Township; and WHEREAS, pursuant to N.J.S.A. 40A:4-53h, the Township desires to authorize a special emergency appropriation in the amount of $1,800,000 to fund the cost of contractually required severance liabilities resulting from the retirement of employees of the Township. BE IT ORDAINED AND ENACTED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, IN THE COUNTY OF ESSEX, STATE OF NEW JERSEY (not less than the majority of all members thereof affirmatively concurring) AS FOLLOWS: SECTION 1. Pursuant to N.J.S.A. 40A:4-53h, the amount of $1,800,000 (i) is hereby appropriated to fund the cost of contractually required severance liabilities resulting from the retirement of employees of the Township, and (ii) shall be deemed a special emergency appropriation as defined and provided for in N.J.S.A. 40A:4-53h. SECTION 2. To finance the appropriation authorized hereunder, and described in Section 1 hereof, special emergency notes of the Township (the “Notes”) shall be authorized by a resolution of the Township Council of the Township to be adopted in accordance with the provisions of N.J.S.A. 40A:4-55. SECTION 3. A certified copy of this ordinance as finally adopted will be filed with the Director of the Division of Local Government Services, in the New Jersey Department of Community Affairs.
