31-25 January 28, 2025 Resolution Authorizing Disposal of Surplus Property WHEREAS, the Township of West Orange is the owner of certain surplus property which is no longer needed for public use; and WHEREAS, the Township is desirous of selling said surplus property in an “As is” condition without express or implied warranties. NOW THEREFORE, BE IT RESOLVED by the West Orange Council of the Township of West Orange: (1) The sale of the surplus property shall be conducted through Municibid pursuant to State Contract 19-GNSV1-00696 in accordance with the terms and conditions of the State Contract. The terms and conditions of the agreement entered into with Municibid is available online at www.municibids.com and available on the Township Website. (2) The sale will be conducted online and the address of the auction site is www.municibid.com at a date and time to be determined. (3) There is no listing fee charged to the Township. (4) The sale will be conducted pursuant to N.J.S.A 40A:11-36 and Local Finance Notice 201915. (5) A list of the surplus property is attached as “Exhibit A” hereto. (6) The surplus property as identified shall be sold in an “as-is” condition without express or implied warranties with the successful bidder required to execute a Hold Harmless and Indemnification Agreement concerning use of said surplus property. 32-25 January 28, 2025 RESOLUTION WHEREAS, on or about December 10, 2012, Larry and Mary Freeman (collectively the “Borrowers”) executed a Mortgage in the amount of $35,000 (the “Mortgage”) to secure a loan through the Township of West Orange’s Housing Rehabilitation Program on the property located at Block 132, Lot 32 on the Tax Map for the Township of West Orange, commonly known as 8 High Street, West Orange, New Jersey 07052 (the “Property”); and WHEREAS, the Mortgage was recorded on January 9, 2013, as Instrument 13002056 in Mortgage Book 12410, Page 725 with the Essex County Register of Deeds and Mortgages; and WHEREAS, the loan through the Township of West Orange’s Housing Rehabilitation Program provides for a forgiveness of the loan at the twelfth (12th) anniversary of the release of payment for the loan; and WHEREAS the twelfth (12th) anniversary of the release of payment for the loan has passed; and WHEREAS, the Township of West Orange seeks the execution of a Discharge of Mortgage, annexed hereto as Exhibit “A,” to record that the loan has been forgiven, and the Mortgage has been satisfied and discharged. NOW, BE IT RESOLVED THAT the Mayor be and is hereby authorized to execute the Discharge of Mortgage, annexed hereto as Exhibit “A,” as to the Property; and be it further RESOLVED that the Municipal Clerk be and is hereby authorized to attest to the Mayor’s signature on the Discharge of Mortgage concerning the Property; and be it further RESOLVED that a copy of the Resolution shall be made available in the Clerk’s office in accordance with applicable law. 32-25 DISCHARGE OF MORTGAGE WHEREAS on December 10, 2012, Borrowers Larry and Mary Freeman (collectively the “Borrowers”) executed a Mortgage in the amount of $35,000 (the (“Mortgage”) to secure a loan through the Township of West Orange’s Housing Rehabilitation Program on the Borrowers’ property located at 8 High Street, West Orange, New Jersey 07052 (the “Property”); and WHEREAS the Mortgage was recorded with the Essex County Register of Deeds and Mortgages on January 9, 2013, as Instrument 13002056 in Mortgage Book 12410, Page 725; and WHEREAS the loan through the Township of West Orange’s Housing Rehabilitation Program provides for a forgiveness of the loan at the twelfth (12th)) anniversary of the release of payment for the loan; and WHEREAS the twelfth (12th) anniversary of the release of payment for the loan has passed. This Mortgage has been PAID IN FULL or otherwise SATISFIED and DISCHARGED. THEREFORE, the Lender Township of West Orange declares that the Mortgage recorded on January 9, 2013 as Instrument 13002056 in Mortgage Book 12410, Page 725 be and is hereby SATISFIED and DISCHARGED. It may now be discharged of record. This means that the Mortgage is now canceled and void. 33-25 January 28, 2025 RESOLUTION WHEREAS, the Township of West Orange (the “Township”) acquired and currently owns the Rock Spring Golf Club located at 90 Rock Spring Road, West Orange, New Jersey also known as Block 160, Lots 2 & 10; Block 160.01, Lots 30 & 34 and Block 46.01, Lot 22 on the West Orange Tax Map which consists of approximately 138 acres (“Rock Spring”); and WHEREAS, as part of the Green Acres application for grants from the New Jersey Department of Environmental Protection, the Township must submit two (2) Green Acres qualified appraisals; and WHEREAS, Hendricks Appraisal Company, LLC has provided a proposal for one (1) of the two (2) required appraisal reports; and WHEREAS, the Hendricks Appraisal Company, LLC’s proposal includes costs of services based on the type of property being appraised, the scope or work to be performed, recognizing the additional regulations and requirements imposed by the New Jersey DEP Green Acres Program, the fee proposed for this appraisal is twenty thousand ($20,000) dollars; NOW, BE IT HEREBY RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF WEST ORANGE, that the Township Council authorizes the Mayor to execute and retain Hendricks Appraisal Company, LLC for the Green Acres Appraisal of Rock Spring as attached herein as Exhibit “A,” not to exceed $20,000 to complete the scope of work; RESOLVED, that a copy of this Resolution shall be made available in the Clerk’s office in accordance with applicable law. 34-25 January 28, 2025 DISPOSAL OF EQUIPMENT WHEREAS, the Township of West Orange wishes to dispose of an obsolete mail machine that is no longer needed for public use which has surpass its useful life expectancy. WHEREAS, N.J.S.A. 40A:11-36 authorizes the disposition of personal property not needed for public use without public sale when the fair value of the property is less than $6600.00 (15 percent of the bid threshold); and WHEREAS, the equipment set forth below has a value of less than $6600.00; and Pitney Bowes Send Pro Connect + 2000 Serial number 6013148 WHEREAS, the equipment has been replaced with what was required by the US Postal Service; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of West Orange, in the County of Essex, New Jersey that the obsolete equipment referenced by the Fire Official which is no longer needed for public use by the Township shall be disposed of according to the manner as prescribed by law. 35-25 January 28, 2025 RESOLUTION WHEREAS, pursuant to N.J.S.A. 40:67-23.2 et. seq, commonly referred to as the Municipal Services Act, the Township of West Orange entered into an Agreement with Llewellyn Park entitled “Municipal Services Agreement” and dated December 23, 2010; and WHEREAS, the Municipal Services Agreement specified the services the Township shall provide Llewellyn Park or the cost of services the Township shall reimburse to Llewellyn Park; and WHEREAS, the Agreement included Leaf Collection from the Park roads as a service and specifies the method for calculating the reimbursement, and it also includes the removal of obstructions such as fallen tree limbs as a service; and WHEREAS, there is attached hereto a report of the Municipal Engineer recommending reimbursement for 2024 Leaf Collection costs to Llewellyn Park in accordance with the formula for reimbursement set forth in the Agreement with Llewellyn Park; and WHEREAS, the Township of West Orange wishes to reimburse Llewellyn Park as set forth in the aforementioned report of the Municipal Engineer. NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of West Orange that Llewellyn Park be reimbursed as set forth therein, on the attached report of the Municipal Engineer, Zayibeth Carballo, for 2024 leaf collection. BE IT FURTHER RESOLVED that the Township Chief Financial Officer issue the appropriate checks to comply with this Resolution as soon as feasible. Karen J. Carnevale, R.M.C.
