179-25 July 22, 2025 RESOLUTION REQUESTING APPROVAL OF ITEMS OF REVENUE AND APPROPRIATION NJS 40A:4-87 WHEREAS, NJS 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law; and WHEREAS, the Director may also approve the insertion of an item of appropriation for equal amount, NOW, THEREFORE, BE IT RESOLVED, that the Township Council of the Township of West Orange in the County of Essex, in the State of New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2025 in the sum of $250,581.88, which is now available from the Design Phase award of the 2020 Transportation Alternative Grants (TAP) Washington Street Corridor Phase I; BE IT FURTHER RESOLVED, that the like sum of $250,581.88. is hereby appropriated under the caption 2020 TAP Washington Street Corridor Phase I Design Phase; and BE IT FURTHER RESOLVED that the above is the result of funds from New Jersey Department of Transportation and Economic Development, in the amount of $250,581.88, I, Karen J. 216-25 September 30, 2025 RESOLUTION AWARDING PROFESSIONAL SERVICES CONTRACT FOR AFFORDABLE HOUSING PLANNER TO HEYER GRUEL& ASSOCIATES WHEREAS, the Township of West Orange (the “Township”) administers an affordable housing program for qualified based on income eligibility consistent with the regulations promulgated by the Council on Affordable Housing and the Uniform Housing Affordability Controls, N.J.A.C. 5:80-26.1, et. seq. and N.J.A.C. 5:97, et. seq.; and WHEREAS, pursuant to the Fair Housing Act, N.J.S.A. 52:27D-301, the New Jersey Department of Community Affairs (“DCA”) issued its report entitled Affordable Housing Obligations for 2025-2035 (Fourth Round), therein setting froth the present need and prospective need for all New Jersey municipalities for the Fourth-Round housing cycle; and WHEREAS, the present need obligation of the Township has been calculated at 409 affordable units, and its prospective need obligation has been calculated as 660 affordable units; and WHEREAS, Heyer, Gruel & Associates (“Heyer”) submitted a Proposal for Professional Services in response to a Request for Qualifications (the “RFQ”) for an Agreement for Fair Share Housing Planner (the “Contract”); and WHEREAS, on May 13, 2025, Heyer submitted a proposal to complete a draft of the Housing Element & Fair Share plan on behalf of the Township in an amount not to exceed $43,500 (the “Proposal”). A copy of the Proposal is attached herein as Exhibit “A;” and WHEREAS, due to the required amendments to the Housing Element & Fair Share Plan, presented to the Planner by the Planning Board, Heyer did not complete the Proposal within the original Not to Exceed clause; and 4902-3943-9681, v. 1
WHEREAS, the Township seeks to retain Heyer to complete the Housing Element and Fair Share Plan in accordance with the proposed Contract annexed hereto as Exhibit “B” WHEREAS, the proposed Contract, annexed hereto as Exhibit “B,” in an amount not to exceed an additional $23,000 based on the following pricing: Principals $175 per hour; Principal Planners $165 per hour; Senior Planners $150 per hour; Associate Planners $135 per hour; and Administrative Agents $110 per hour. NOW, BE IT HEREBY RESOLVED, by the Township Council of the Township of West Orange that the Township authorizes the award and execution of the Contract with Heyer, annexed hereto as Exhibit “B” to expire on December 31, 2025; and be it further RESOLVED that a copy of this resolution shall be available in the Clerk’s office in accordance with applicable law. Smeraldo, Jr., Business Administrator Township of West Orange 66 Main Street West Orange, NJ 07052 RE: Affordable Housing Township of West Orange Dear Mr. Smeraldo, As requested, we would be pleased to provide professional planning services associated with affordable housing to the Township of West Orange. Heyer, Gruel & Associates is a community planning consulting firm providing a wide range of planning services to over 40 municipalities throughout the State of New Jersey. We believe our firm is well qualified to provide affordable housing planning services to the Township. The firm’s qualifications are detailed in our RFQ submission documents. Susan S. Gruel would serve as Affordable Housing planner for the Township. She has extensive experience working with municipalities, municipal planning experience including experience in affordable housing and preparing affordable housing plans. Additional staff will be utilized as necessary. Our fee for preparation of a draft Housing Element & Fair Share Plan and a Spending Plan in accordance with the recently amended Fair Housing Act would not exceed $43,500 billed at the attached hourly rates. Our scope would include preparation of the Plans and one kickoff meeting with Township representatives. All other meetings including public hearings would be billed at our hourly rates and would not be under the cap. We anticipate that it would take between 4-6 months to prepare draft Plans and, as we discussed, would not meet the June 30 deadline. AGREEMENT FOR AFFORDABLE HOUSING PLANNING SERVICES THIS AGREEMENT made and entered into on this ____ day of September, 2025 by and between the TOWNSHIP OF WEST ORANGE, a municipal corporation of the State of New Jersey, located at Town Hall, 66 Main Street, West Orange, County of Essex and State of New Jersey, hereinafter called the “TOWNSHIP,” party of the first part, and HEYER, GRUEL & ASSOCIATES, located at 236 Broad Street, Red Bank, New Jersey 07701, County of Monmouth hereinafter referred to as “CONSULTANT,” party of the second part. WITNESSETH THAT: WHEREAS, the Governing Body of the TOWNSHIP has determined that it is in the best interests of the TOWNSHIP to retain the services of CONSULTANT to provide affordable housing planning services; NOW, THEREFORE, in consideration of the mutual promises, terms and conditions hereinafter set forth, the parties hereto agree as follows: 1. CONSULTANT shall prepare and file the fair share housing plan regarding the Fourth Round obligations of the Township concerning its present need obligation of the 409 affordable units, and its prospective need obligation at 660 affordable units as well as other work related to affordable housing as directed by the Business Administrator and/or their designee. The above work other than site visits and meetings will be conducted in CONSULTANT’s office. It is assumed that application materials will be mailed to CONSULTANT by Township staff, although CONSULTANT will be able to pick up materials in West Orange if a quick turnaround of a review letter is necessary. A representative of CONSULTANT will also attend meetings in West Orange to meet with Township staff, other consultants and/or development applicants, as needed.
