213-26 August 4, 2026 RESOLUTION AUTHORIZING ELECTRONIC TAX SALE AND COST OF MAILING WHEREAS, NJSA 54:5-19.1 authorizes municipalities to conduct electronic tax sales pursuant to rules and regulations to be promulgated by the Director of the Division of Local Government Services, and WHEREAS, the Director of the Division of Local Government Services has approved NJ Tax Lien Investors/Real Auction.com to conduct electronic tax sales, and WHEREAS, an electronic tax sale is innovative and provides a greater pool of potential lien buyers, thus creating the environment for a more complete tax sale process, and WHEREAS, the Township of West Orange wishes to participate in an electronic sale. WHEREAS, the rules and regulations require a municipality to send two (2) notices of tax sale to all properties included in said sale; and WHEREAS, the rules and regulations allow said municipality to charge a fee of $25.00 per notices for the creation, printing and mailing of said notice; and WHEREAS, in an effort to more fairly assign greater fiscal responsibility to delinquent taxpayers, the Township of West Orange will charge $25.00 per notice mailed which will be assesses specifically to the delinquent accounts that are causing the need for a tax sale and not the general tax base. NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of West Orange, that the Tax Collector is hereby authorized to participate in the electronic tax sale and submit to the Director of Local Government Services if necessary. 214-26 August 4, 2026 RESOLUTION WHEREAS, the Township Council of the Township of West Orange has determined that there exists a need to provide the following professional services for the Township: Professional Traffic Engineering Services; and WHEREAS, pursuant to the New Jersey Local Unit “Pay to Play Law, N.J.S.A. 19:44A- 20.4 et seq., the Township has sought said qualified professional services through the use of a “fair and open process,” as defined in N.J.S.A. 19:44A-20.7; and WHEREAS, the Professional Services are exempt from the requirements of public bidding pursuant to the Local Public Contracts Law, more specifically, N.J.S.A. 40A:11- 5(1)(a)(i); and WHEREAS, as required by this law, the Township provided sufficient notice of its Request for Proposals/Qualifications; publicly solicited RFPs through the utilization of the Township’s official Web site; established an award and disclosure process documented in writing prior to soliciting any RFPQs; publicly opened all proposals; and publicly will award the Contract via this Resolution of the Township Council; and WHEREAS, the Township has determined that retaining Bright View Engineering, LLC, 15 Oak Road, Suite 4, Fairfield, New Jersey 07004 will be the most advantageous to the Township, all relevant factors considered. NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Township of West Orange in the County of Essex, State of New Jersey that Bright View Engineering, LLC, 15 Oak Road, Suite 4, Fairfield, New Jersey 07004 be and is hereby approved for this professional service for a term expiring on December 31, 2026; and BE IT FURTHER RESOLVED, that the Mayor and Township Clerk are hereby authorized to sign the agreement on behalf of the Township, which shall be available for public inspection in the office of the Township Clerk; and BE IT FURTHER RESOLVED, that the Business Disclosure Entity Certification and the Determination of Value Certification be placed on file with this resolution; and
BE IT FURTHER RESOLVED, that compensation for services rendered shall be claimed, approved and paid in the manner set forth in N.J.S.A. 40A:5-16 and pursuant to a professional service agreement to be entered between the parties; and, BE IT FURTHER RESOLVED, that the maximum dollar amount of this contract is reasonably estimated to be $7,500.00 over the contract term; however, the Township is not obligated to spend this amount and if exceeded, can be funded by additional encumbrances; and, BE IT FURTHER RESOLVED, that the Township Clerk shall cause a notice of the adoption of this resolution to be posted to the Township website at www.westorange.org, “Current Legal Notices”, “Resolution Notices,” within ten (10) days after passage hereof. This proposal is based on our discussions with you and experience providing similar services to the various municipalities. PROJECT UNDERSTANDING The purpose of this proposal is to provide the services requested in your July 15, 2026, email to our office. It is our understanding that we will be providing services as described in the Scope of Work items below. Review transportation-related components of a proposed project located at 762 Pleasant valley Way, Township of West Orange, Essex County, New Jersey. The project site is designated as Block 154.21, Lot 34. Access to the site is proposed via one (1) right-in/right-out driveway along Pleasant Valley Way. The project includes a proposed multi-family residential development consisting of 79 dwelling units and 150 parking spaces. PAHSE 1 TRAFFIC REVIEW Bright View Engineering shall provide all of the services requested to review the transportation- related components of the project. We shall provide professional planners, traffic planners, traffic engineers and support staff as needed. The review services being requested by the Township include, but may not be limited to, the following tasks: • Review and advise the Township on the proposed access plan for the development and rights- of-ways surrounding the project in terms of vehicular, pedestrian, and bicycle circulation, as well as the parking operations; • Review the Traffic Impact Study and Traffic Memorandums and make recommendations as to the adequacy of the submission and whether changes are needed to obtain advantageous traffic and circulation outcomes for the Township; • Prepare one (1) review memoranda. Should additional reviews be required beyond the initial review, we shall prepare a separate work order for additional services. • Attend one (1) in-person meetings or teleconference meetings with the Township, as needed. PHASE 2 MEETINGS, Consultations, Availability (as needed) Our staff members shall be available as needed to attend meetings and perform the services outlined in the scope of work. We shall endeavor to provide timely, responsive service on a as needed basis. Our project team leader John Jahr shall be available for telephone consultations as needed. Our Team leader anticipates attending meetings with developers, sub-committee meetings and all- night meetings, as needed. Attendance at agency and project coordination (including with client and other consultants) meetings will be billed hourly in accordance with the Schedule of Hourly Rates in effect at the time the meeting is held. Time spent preparing for meetings will be billed hourly in accordance with the Schedule of Hourly Rates in effect at the time the service is completed. Delivery, printing, and reproduction, overnight mail service and postage costs are not included in the fees and will be added to each monthly invoice. Professional services will include all necessary equipment and materials, and will be invoiced monthly on a time and materials basis. Estimated not-to-exceed cost of providing these services: $7,500 Meetings T&M EXCLUSIONS AND CLARIFICATIONS Services relating to the following items are not anticipated at this time with regard to the current scope of service for this project. Therefore, any services associated with the following items are specifically excluded from the scope of professional services within this agreement: • Services not specifically outlined above in Scope of Service; • Data Collection; • Meetings; • All out-of-pocket expenses including, but not limited to, application fees, permit fees laboratory testing costs, mylar copies, certified mailings, photographs, blueprints, and special deliveries will be charged at cost and passed on to you for payment. Should we experience unanticipated conditions we shall notify you at once. We will provide you with an explanation of the issue and remedies that mitigate the issues.
