Chairman Buechler said that the Board will now deliberate and render a decision to this application and he asked the public to express their comments after the decision is announced outside of the chamber so that the Board can continue with the remainder of the Zoning Board meeting. Chairman Buechler stated that there are seven (7) voting Board Members and that is adequate for “d” and “c” variances. He said that Ms. Nash and Mr. Schwarzbaum will not be voting. Chairman Buechler stated that he would like to take a poll from the Board Members just to gauge how they will be voting; whether they will approve or deny this application. He said that this will not be the formal vote and asked the Board Members if they would agree to a short circuit vote; they were all in favor. Mr. Bullock stated that he is leaning to deny this application. Ms. Gabry stated that she will vote to deny this application. Vice Chairman Neuer stated that he will vote to deny this application. Mr. Sussman stated that he will vote to deny this application. Mr. Steinhart stated that he will vote to deny this application. Mr. Quentzel stated that he is going to abstain from voting. Chairman Buechler stated that he will vote to approve this application with modifications and conditions. Chairman Buechler stated that there are five votes to deny the application and asked the Board if they want to have a discussion or go to the formal vote. He also noted for the record that the Board’s decision may be appealed. Ms. Beirne stated that she would like the Board Members to state the reason for their vote for the resolution. Chairman Buechler asked for a motion from the Board. Vice Chairman Neuer moved to deny the entirety of the Quick Chek application requesting preliminary and final site plan approval and all of the variances. Ms. Gabry seconded the motion. Chairman Buechler asked the Board Secretary to call for the vote. Mr. Bullock stated that this application had several safety issues that cannot be overlooked and the citizen opposition cannot be ignored.
