Show all pagesVice Chairman Neuer stated that the Board also needed to see a copy of any cross-easement agreements between the hotel and proposed Quick Chek properties, and they did not see it. Vice Chairman Neuer said that as long as he has been sitting on this Board, he has never seen an application come before them requesting twenty two (22) variances; he said the Board has approved one or two variances but never twenty two (22). Vice Chairman Neuer went on to explain some of the variances required for this application. He said that the building and impervious coverage will be increased, the lot is undersized for two uses even though the Township Ordinance permits two uses on one property in a B-2 zone. He went on to say there is a requirement that the fuel station must be 500’ away from a public building. Even though there was credible testimony regarding current safety requirements there was no testimony regarding other factors which would justify being in close proximity to both a school and public buildings, the Arena Complex. Vice Chairman Neuer stated the applicant did not prove why they wanted to squash two conditional uses into this site. He said that he also had concerns about pedestrian and vehicular circulation on the two proposed properties. Vice Chairman Neuer stated that he disagrees with the testimony provided that no one will be there between midnight and five (5) a.m. He said that there are no other gas stations in town that provide gas after midnight and if someone needs gas at that time their GPS will direct them to this site. Vice Chairman Neuer stated that leaving a car at the gas pump to go shopping is a pet peeve of his. He said that he believes that it is unsafe to walk through the lanes of traffic and blocking the lanes with your car. There was no credible evidence presented to allay these safety concerns which were stated on the record. Vice Chairman Neuer stated that these are his personal opinions and beliefs and he does this with a heavy heart, because Quick Chek is a company that will be welcome in this community, but he is compelled to vote yes to deny this application. Mr. Quentzel stated that he has been looking into the benefits of having a convenience store with fuel pumps on this site. He said they have made changes to the initial proposal, reducing the number of gas pumps and the square footage but, after listening to Vice

Mr. Quentzel said that he is concerned with safety issues because the site is across the street from the zoo and children trying to cross the street to get to the site is very dangerous. He said that this is very difficult for him and initially he was going to abstain from voting but, after listening to Vice Chairman Neuer on the record, he believes that this is too much for this site. Mr. Quintzel stated that this is not a good location and that he is voting yes to deny the application.
