AGENDA-Amended February 8, 2011 Township of West Orange 66 Main Street – 7:00 p.m. This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 19, 2010. A notice of this meeting was also posted on the Bulletin Board in the Municipal Building, West Orange and filed in the office of the Municipal Clerk of the Township of West Orange on November 19, 2010. Statement of Decorum In all matters not provided for in subsection 3-15.1 and except upon consent of the Council President, each person addressing the Council pursuant to this subsection shall be required to limit his or her remarks to five (5) minutes, and shall at no time engage in any personally offensive or abusive remarks. Ordinances on Second and Final Reading a. 2303-11An Ordinance Amending and Supplementing Chapter 2, “Administration”, Article IX, “Administrative Policies and Procedures”, by Adding a New Section 2-82 Entitled, “Citizen Service”, to Provide for Open Applications and a Public Directory of Township Council Appointed Municipal Positions This ordinance is to establish a set of procedures for the advertisement of information concerning various positions open to citizens through appointment by the Township Council. b. 2305-11 An Ordinance Amending and Supplementing Chapter 2 Section 10.1 of the Revised General Ordinances of the Township of West Orange, Entitled “Director of Public Words; Duties of Department” The purpose of this ordinance is to establish the position of Deputy Municipal Department Head of Public Works/Engineering who shall have the authority to perform the duties in the event that the Director of Public Works position is vacant. c. 2306-11 An Ordinance Amending an Ordinance Creating a Reclassification and Salary Schedule of

Cultural Affairs position is vacant. e. 2308-11 An Ordinance Amending and Supplementing Chapter 2 Section 11.1 of the Revised General Ordinances of the Township of West Orange, Entitled “Department Generally” – Deputy Municipal Department Head of Planning/Development The purpose of this ordinance is to establish the position of Deputy Municipal Department Head of Planning/Development who shall have the authority to perform the duties in the event that the Director of Planning position is vacant. 10. REMOVED b. 2310-11 An Ordinance Amending and Supplementing Chapter 23 Section 1.1 of the General Ordinances of the Township of West Orange Entitled “Pool Fees and Rates” The purpose of this ordinance is to establish the fees and rates for the Ginny Duenkel Pool for the 2011 season. c. 2311-11 An Ordinance Amending and Supplementing Chapter 25 Section 51.1 and 51.2 of the General Ordinances of the Township of West Orange Entitled “Application Procedures and Administrative Requirements” The purpose of this Ordinance is to incorporate the checklists prepared by the Department of Planning and Development into the portion of the ordinance establishing the process for the submission of development applications. This Ordinance also adds additional documents that must be provided when a development application is submitted to the Township of West Orange. d. 2312-11 Ordinance of the Township of West Orange, in the County of Essex, Making Certain Amendments to the Historic Downtown Development Plan An ordinance approving an amendment to the Historic Downtown Redevelopment Plan to allow school bus parking and maintenance as a permitted use in certain areas. *11. Resolutions a. 17-11 Resolution Authorizing Entry and Execution of the Municipal Joint Defense Group Agreement & Designation of Municipal Liaison Counsel in the Action Entitled NJ DEP v. Occidental Chemical Corporation, et al. b. 18-11 Resolution Authorizing the Award of a Non-Fair and Open Contract for TRC Environmental Corporation (“TRC”) 57 East Willow Street, Millburn, New Jersey 07041 to Provide Environmental Consulting Services for 22-24 Central Avenue, West Orange, New Jersey in an Amount NTE $40,910 The non-fair and open process does not require the competitive elements of the fair and open process, i.e. Requests for Proposal or Requests for Qualifications. In the non-fair and open process, a local unit may award a contract subject to a vendor reporting requirements and certifications stating that no prohibited contributions were made to the political committees of the local unit as defined by N.J.S.A. 19:44A-20.26 c. 19-11 Resolution Authorizing Raffle Licenses d. 20-11 Resolution Rejecting Bid Proposal from Ocean Clean, Cedar Grove, NJ and Awarding a Contract to Excellent Building Services, Corp., Orange, NJ in the Amount of $57,540. for Janitorial Services at Several Municipal Buildings Ocean Clean failed to provide its experience and qualifications and failed to provide references therefore their proposal was rejected. e. 21-11 Resolution Authorizing an Agreement with Goose Control Technology for a Term of One Year at a Rate NTE $3000. This contract is continued from prior years for the control of geese in Degnan Park, including the island, Crystal Lake area and Stagg Field where there has been known to be a Canada Geese problem in the past. This proven measure of addling the eggs in the nests to prevent eggs from hatching into goslings and increasing the resident goose population has kept the numbers down so that the park may be used by our residents. This contract also provides for the supervision of volunteers that want to participate in this process. This contract was negotiated down $1,000 in 2010 to $3,000 and remains the same amount for 2011.
f. 22-11 Resolution Authorizing the Engagement of Frank Arleo, Esq. of Arleo Donahue & Biancamano, West Orange, NJ to Represent the Interests of Township Employees John K. Sayers and James P. Abbott with Regard to Probable Cause Hearing and Related Matters in the Amount of $150. Per hour NTE $5,000. g. 23-11 Resolution Authorizing Deeds of Easement and Easement Agreements With One (1) Property Owner(s) at 230-232 Eagle Rock Avenue, Block 112.02, Lot 5.01 h. 24-11 Resolution Authorizing a Contract with All State Technology, Inc., 10 Lark Lane, Oak Ridge, NJ 07438, in the Amount of $112,000. for the Restoration of the Ginny Duenkel Municipal Pool Surfaces i. 25-11 Resolution Authorizing Reimbursement of the Costs of Private Garbage Collection for Private Home Owner Associations or Individuals for the Period of January 1, 2010 – December 31, 2010. j. 26-11 Resolution Authorizing Appropriation ReserveTransfer # 4 k. 27-11 Resolution to Award State Contract Vendor for 2011 Contract for Tires & Tubes to Kirk’s Tire Co., 185 Central Ave., Orange, NJ 07050 This resolution will allow the Township to make purchases for the current year of 2011 above the bid threshold of $36,000.00 for vehicle tires and tubes without going to bid. 12. ABC Hearing a. 454-11 Hearing and Resolution on Applications for Renewal of Plenary Retail Consumption and Distribution Licenses for the 2010-2011 License Term- SUZYQUE’S LLC t/a Suzy Que’s The establishment included in this resolution has recently received tax clearance and is ready for renewal. 455-11 Application for Person to Person Transfer, Plenary Retail Consumption License No. 0722-33-009- 010, from 34 South Valley Associates, Inc. to SUZYQUE’S LLC t/a Suzy Que’s 13.
