AGENDA May 31, 2011 Township of West Orange 66 Main Street – 7:00 p.m. This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 19, 2010. A notice of this meeting was also posted on the Bulletin Board in the Municipal Building, West Orange and filed in the office of the Municipal Clerk of the Township of West Orange on November 19, 2010. Statement of Decorum In all matters not provided for in subsection 3-15.1 and except upon consent of the Council President, each person addressing the Council pursuant to this subsection shall be required to limit his or her remarks to five (5) minutes, and shall at no time engage in any personally offensive or abusive remarks. The chair shall call any speaker to order who violates any provision of this rule. Coleman Regarding General Improvement Bonds Awarded to Morgan Stanley and Company, Totaling $11,505,000.00 and bear an Net Interest Rate of 3.297002% (Net Interest Cost-$3,190,048.26). The Bonds are dated May 1, 2011 and will mature annually until May 1, 2026. b. Correspondence from Chief Financial Officer, Edward J. Coleman Regarding Bond Anticipation Notes Awarded to TD Securities (USA) LLC, Totaling $6,453,098.00 and bear an Net Interest Rate of .7309% (Net Interest Cost-$46,118.14). The Notes are dated June 2, 2011 and will mature annually until May 24, 2012. *7. Reports - Municipal Judge’s Report for the Month of April, 2011 *8. Bills 9. Ordinances on Second and Final Reading a. 2320-11 An Ordinance Repealing and Amending Chapter 13, Section 3 of the Revised General Ordinances of the Township of West Orange (Construction Board of Appeals) The purpose of this ordinance is to repeal the sections of the West Orange Township Ordinance establishing a local construction board of appeals.

ownship of West Orange (Construction Board of Appeals) The purpose of this ordinance is to repeal the sections of the West Orange Township Ordinance establishing a local construction board of appeals. By repealing the statute and dissolving the local construction board of appeals, any and all appeals from the decisions of the Township’s enforcing agency would be adjudicated by the County Construction Board of Appeals. These measures would reduce costs to the Township in reducing the administrative costs associated with adjudicating appeals, including overtime costs, publication/advertisement fees, and copying and other administrative costs. b. 2321-11 An Ordinance Amending an Ordinance Creating a Reclassification and Salary Schedule of Certain Township of West Orange Employees Setting Forth Their Titles, Classification and Salary Ranges and Adopting a Salary Guide and Establishing the Employee’s Status as a Township Employee and Under the Guidelines of the New Jersey Department of Personnel The ordinance reflects a change in responsibility of the Assistant Township Attorney. 10. a. 2322-11An Ordinance Authorizing Special Emergency Appropriations Pursuant to N.J.S.A. 40A:4-53 for Severance Liabilities Resulting From Accrued Leave In Connection with the Retirement of Employees The Township will sell Notes for this Appropriation. b. 2323-11 An Ordinance Authorizing the Reconstruction of the System of Sewerage and Drainage and Associated Repair, Reconstruction and Repaving of the Roadways Within the Llewellyn Park Section of the Township of West Orange as Local Improvements to be Assessed Upon the Abutting Land Pursuant to NJSA 40:49-6 and NJSA 40:56-1, Et. Seq. (second reading on June 28, 2011) *11. Resolutions a. 119-11 Resolution Authorizing a Refund of 2010 Property Taxes in the Amount of $10,074.50 for Overpayment for 9 Elm Court Way, West Orange, NJ b. 120-11 Resolution Authorizing a Refund of 2009 Property Taxes in the Amount of $1,254.70 and 2010 Property Taxes in the Amount of $1,298.20 for Overpayment for 41 Sunnyside Road, West Orange, NJ c. 121-11 Resolution Authorizing Raffle Licenses H/Od. 122-11 120-11 Resolution Authorizing a Refund of 2008 Property Taxes in the Amount of $6,135.76, 2009 Property Taxes in the Amount of $6,348.78 and 2010 Property Taxes in the Amount of $4,878.22 for Overpayment for 568 Mount Pleasant Avenue, West Orange, NJ (heldover-for 6/14 meeting) e. 123-11 Amendment to the Municipal Budget 2011-1 The Budget Amendment amends the Budget approved by Council on March 29, 2011, and reflects technical changes requested by the Division of Local Government, and increases and decreases in various items of appropriation due to five (5) months of Budget History and projections thru the end of calendar year 2011, and increase in Revenues Anticipated to offset the Net Increase in Appropriations. f. 124-11 Resolution Approving Changer Order No. 3 Reducing the Automatic Door Systems, LLC Contract in the Amount of $7,500 to $107,300. and Increasing the Herbst-Musciano Contract in the Amount of $7,500. for the Completion of all Construction Contract Administrative Services g. 125-11 Resolution Authorizing a Settlement Agreement Between the Townshipof West Orange and West Orange Senior Citizens Housing Association in the Amount of $134,840. 1. The PILOT due and owing to the Township from the Sponsor shall be reduced to $60,000 per year until the Sponsor receives full credit for the over payments made to the

Once the Over Payments are credited to the Sponsor, Sponsor shall resume paying the Township its full PILOT as calculated pursuant to the provisions of the Tax Agreement. h. 126-11 Resolution Authorizing Change Order No. 1 & Final for A&J Contractor’s Group, Inc., 105 Federal Road, Monroe Township, NJ, in the Amount of $21,181.54 This Change Order No. 1 and Final reflects as built quantities and decreases the original contract in the amount of $21,181.54. i. 127-11 Resolution Authorizing the Acquisition of Two Parcels of Undeveloped Land on Wiley Terrace for Open Space and Recreation Purposes The Open Space & Recreation Committee voted to recommend to the Township Council the acquisition of two parcels of land on Wiley Terrace. This Resolution authorizes the Administration to proceed with the acquisition and it will be partially funded using a Planning Incentive Grant from the Green Acres Program. j. 128-11 Resolution to Extend 2010 Contract for the Food & Beverage Concession Stand at the Ginny Duenkel Municipal Pool for 2011 to Bagelwich Bagel Bakery This resolution will extend the current contract for the pool concession stand for the 2011 season. This is the final extension under the Local Public Contracts Law NJSA 40A:11-15(10) which states that the providing of food services for any term can not exceed three years. This contract has been in effect since 2009. k. 129-11Resolution to extend 2010-2011 Auto Body Repair Contract to A. Lembo Car & Truck Collision, Inc., 76 Riverside Avenue, Newark, NJ for year 2011-2012 NTE 2011 Budget Appropriation This resolution extends a current contract that is financially advantageous. The annual expense of this contract can range between under $30,000.00 to over $50,000.00 depending on the need for such

repair. This is the final extension under the Local Public Contracts Law NJSA 40A:11-1 for this type of contract. l. 96-11 Award of Bid on State Contract T-1316 with NACR, Inc., 246 Industrical West, Eatontown, NJ 07724 in the Amount of $235,881.26 for the Purchase and Installation of Telecommunication Equipment Upgrade (originally on the May 3, 2011 agenda-tabled) This resolution will award a contract to upgrade the Township’s telecommunications equipment with installation. This will not only provide a scalable platform for the Township’s future needs regarding communication, but will also be a current cost benefit. m. 130-11 Resolution Authorizing an Executive Session to Discuss Contract Negotiations 12.
