1 Conference Meeting – July 16, 2019 The Township Council of the Township of West Orange met in the Council Chambers, Municipal Building, 66 Main Street, West Orange, New Jersey at 6:34 p.m., Karen Carnevale, Municipal Clerk read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975. The annual notice was emailed to the Star Ledger and filed in the Township Clerk’s office on September 26, 2018 and published in the West Orange Chronicle on October 4, 2018. Roll Call: Councilwoman Casalino, Councilman Krakoviak, Councilwoman Matute-Brown, Councilwoman McCartney and Council President Guarino. Joe Fagan, West Orange Township Historian explained that on July 16, 2007, James Sheeran, former Mayor of West Orange and decorated World War II veteran passed away and asked that a moment of silent be observed at the opening of the Public meeting. He gave a brief presentation about Cybercrimes and Identity Theft. Mr. Bob Chilton, Executive Vice President, Gabel Associates, an energy, environmental and public utility consulting firm based in Highland Park, New Jersey explained the bid process that took place for the third round of the West Orange Energy Aggregation Program. He presented the results of the bid which took place earlier in the day to the Council and Administration. Mr. Sayers gave an update on Redevelopment. The Council gave their liaison announcements. Tammy Williams, Chairperson of the Human Relations Commission and founder of the W.O. Stop Suicide Advocacy Coalition spoke about the upcoming West Orange Run for Zach, a 5K fundraiser that will take place at the Rock Spring Golf Club on October 6, 2019. At this time, the Council President announced that the ABC Hearing would be conducted on behalf of Wilshire Caterers, LLC t/a Wilshire Catering & Grill 350 as a courtesy due to the fact that attorney is attending the meeting on behalf of his client. ABC Hearing On motion made by Councilwoman Casalino and seconded by Councilwoman McCartney, the Council entered into the ABC hearing as the ABC Board. All members present voting “Aye.” a. 632-19 Place to Place (Extension of Premises) Liquor License Transfer of Consumption License No. 0722-33-048- 011, Wilshire Caterers, LLC t/a Wilshire Catering & Grill 350, 350 Pleasant Valley Way, West Orange, NJ 07052 Mr. Robert Williams, Esq. and his client and owner of the above referenced license, Travis White appeared before the Council.
2 On motion made by Councilwoman Casalino and seconded by Council President Guarino, the above-referenced resolution was approved. All members present voting “Aye”. At the close of the ABC Hearing, on motion made by Councilwoman Casalino and seconded by Council President Guarino the Council meeting resumed. All members present voting “Aye”. All members present voting “Aye.” Ordinance(s) on Second and Final Reading Ordinance 2580-19 On motion made by Councilwoman Casalino and seconded by Councilwoman McCartney, Ordinance of the Township of West Orange, In the County of Essex, State of New Jersey Adopting a Redevelopment Plan Relating to the West Orange Library Redevelopment Area of the Revised General Ordinances of the Township of West Orange was taken up on second and final reading. Councilwoman Casalino, Councilwoman Matute-Brown, Councilwoman McCartney and Council President Guarino voting “Aye.” Councilman Krakoviak voting “Nay.” The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. 4 On motion made by Councilwoman Casalino and seconded by Councilwoman Matute-Brown, the above referenced ordinance was approved. Councilwoman Casalino, Councilwoman Matute-Brown, Councilwoman McCartney and Council President Guarino voting “Aye.” Councilman Krakoviak voting “Nay.” Councilman Krakoviak made a motion to amend the plan as adopted to make two changes to the standards. One to allow to move from 6 habitable floors to 8 habitable floors, and second to allow for higher density of 65 units per acre. There was no second to the motion. The motion failed. A final roll call vote was taken on the above referenced ordinance. Councilwoman Casalino, Councilwoman Matute-Brown, Councilwoman McCartney and Council President Guarino voting “Aye.” Councilman Krakoviak voting “Nay.” Resolution 180-19 a. 180-19 Resolution of Need for Senior Housing for Department of Community Affairs Consideration of Proposed Library Project (Legal-Trenk) At this time, Mayor Parisi made a statement regarding affordable senior housing in the Township. He then introduced Mr. Joe Alpert, The Alpert Group to the Council. Mr. Alpert made a brief presentation which included drawings for the Library Redevelopment project and an explanation as to the PILOT program for this project. Mr. Trenk further explained the project for the Council’s consideration. Ms. Marge Mingin, Library Board Secretary, explained regulations regarding the requirements to apply for the 125 million bonds for libraries passed by NJ voters in November 2017. Mr. Alpert answered questions of the Council. On motion made by Council President Guarino and seconded by Councilwoman Casalino, the above referenced resolution was approved. Councilwoman Casalino, Councilwoman Matute-Brown, Councilwoman McCartney and Council President Guarino voting “Aye.” Councilman Krakoviak voting “Nay.” Resolution 188-19 a. 188-19 Resolution of the Township of West Orange, In the County of Essex, New Jersey, Designating a Redeveloper and Authorizing the Execution of a Redevelopment Agreement for a Portion (the Portion that Contains the West Orange Public Library) of the Property Known as Block 68, Lot 1 on the Tax Map of the Township (Legal-Trenk) On motion made by Councilwoman McCartney and seconded by Councilwoman Casalino, the above referenced resolution was approved. The Mayor introduced Jonathan Schwartz, Partner, BNE Real Estate Group, 16 Microlab Road, Livingston, NJ an affiliate of Essex Green Partners, LLC. Mr. Schwartz made a few brief comments with regard to the above referenced resolution. He showed a preliminary design of the proposed dog park and explained that they were open to suggestions from the public. He and the Mayor answered questions of the Council.

Councilwoman Casalino, Councilwoman Matute-Brown, Councilwoman McCartney and Council President Guarino voting “Aye.” Councilman Krakoviak voting “Nay.” Public Hearing on the 2019 Municipal Budget The Clerk read the following statement: This is the time fixed for the public hearing on the Municipal Budget and Tax Resolution for 2019. The Budget was introduced on First Reading by the Township Council on June 12, 2019, was advertised, as required, on June 20, 2019, together with notice of hearing for this time. Copies were made available to the public a supply is here for anyone desiring a copy. The Council President read the following Statement: Before opening this hearing, I wish to outline the procedure. Each person desiring to be heard will rise and give his or her name and address before speaking. I will recognize one speaker at a time, in order of rising, as nearly as I can determine. Address all questions to the Chair: where necessary they will be referred to individual members of the Governing Body or Municipal Officials. Questions must be confined solely to the Municipal Budget before us; School or County matters are not proper subjects of This hearing and cannot be discussed or answered here tonight. I will entertain a motion to open the public hearing on the Municipal Budget and Tax Resolution of 2019. At 11:47 p.m., on motion made by Councilwoman Matute-Brown and seconded by Councilwoman Casalino, the 2019 budget hearing was opened. All members voting “Aye.” The Council President asked if there was anyone who wished to be heard. Resolution 185-19 a. 185-19 Resolution to Amend Introduced Budget (Gross) Mr. Gross read resolution 185-19 in its entirety as required by law. On motion made by Councilwoman Matute-Brown and seconded by Councilwoman Casalino, the above referenced resolution was approved after a lengthy discussion between the Councilmembers, John Gross and Jack Sayers. Councilwoman Casalino, Councilwoman Matute-Brown, Councilwoman McCartney and Council President Guarino voting “Aye.” Councilman Krakoviak did not provide a vote on roll call.
6 Resolution 178-19 a. 178-19 Resolution to Adopt the 2019 Municipal Budget (Gross) On motion made by Council President Guarino and seconded by Councilwoman Casalino, the above referenced resolution was approved. Councilwoman Casalino, Councilwoman Matute-Brown and Council President Guarino voting “Aye.” Councilman Krakoviak and Councilwoman McCartney voting “Nay.” Ordinance(s) on Second and Final Reading Ordinance 2577-19 On motion made by Councilwoman McCartney and seconded by Council President Guarino, An Ordinance Amending Chapter 2, Section 47.6 of the Revised General Ordinances of the Township of West Orange (Studies and Recommendations) of the Revised General Ordinances of the Township of West Orange was taken up on second and final reading. All members voting “Aye.” The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and public comment was closed. All members voting “Aye.” Ordinance 2578-19 On motion made by Council President Guarino and seconded by Councilwoman McCartney, Calendar Year 2019 Ordinance to Exceed the Municipal Budget Appropriation Limits and to Establish a Cap Bank (N.J.S.A. 40A: 4- 45.14) of the Revised General Ordinances of the Township of West Orange was taken up on second and final reading. All members voting “Aye.” The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. All members voting “Aye.” The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and public comment was closed. On motion made by Councilwoman Casalino and seconded by Councilwoman McCartney, the above-mentioned ordinance was approved on second and final reading. All members voting “Aye.” Ordinances on First Reading Ordinance 2581-19 On motion made by Council President Guarino and seconded by Councilwoman Casalino, An Ordinance Amending and Supplementing Chapter 7, Traffic, Subsection 7-32.1, Handicapped Parking on Streets and Subsection 7-32.2, Restricted Parking Zones, of the Revised General Ordinances of the Township of West Orange was approved on first reading, ordered advertised according to law, to come up for second and final reading on August 13, 2019. All members present voting “Aye”. Pending Matters/New Matters/Council Discussion Councilwoman Casalino stated that she will be providing a list of findings that the Council has from their workshop held on July 9, 2019 to the Administration in preparation of next year’s budget and also suggested having more workshops in the future.
