1 Public Meeting – November 22, 2011 The Township Council of the Township of West Orange met in the Municipal Building, 66 Main Street, West Orange, New Jersey at 7:00 P.M. Karen J. Carnevale, Municipal Clerk read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law, 1975. A notice of this meeting was mailed to the Star Ledger and the West Orange Chronicle on November 19, 2010. Roll Call: Present : Councilman Anderton, Councilman Cirilo, Councilman Krakoviak, Councilwoman McCartney, and Council President Spango Absent : None The Township identified and presented for unanimous consent, Item 5 (Minutes), Item 6 (Communication), Item 8 (Bills), and Item 11 (Certain Resolutions). On motion made by Councilwoman McCartney and seconded by Councilman Cirilo, the Consent Agenda was implemented. All members voting “Aye”. Public Comment The Council President asked if there was anyone who wished to make a statement at this time. Rosary Morelli, 22 Ralph Road, West Orange Mark Meyerowitz, 1 Howell Drive, West Orange Anthony Pugliese, Public Information Officer for Essex County There was no one else who wished to be heard and the public hearing was closed. Bills The Bill List was received and ordered paid. A summary of the Bill List is attached. Resolutions The following resolutions were adopted. 2 Resolution Authorizing the Implementation of a Social Media Policy in the Human Resources Policies an Procedures Manual for all Township Employees/Representatives Resolution #266-11 Resolution Authorizing Raffle Licenses Resolution #267-11 Resolution Awarding a Contract for the Provision of Recreational Services and Social Services to the Residents of the Township of West Orange for the Period Commencing January 1, 2011 – December 31, 2011 in the Amount of $45,000 Resolution #268-11 Resolution Awarding a Contract for the Provision of Recreational Services and Social Services to the Residents of the Township of West Orange for the Period Commencing January 1, 2011- December 31, 2011 in the Amount of $9,500 Resolution #271-11 Resolution Authorizing the Chief Financial Officer to Eliminate from the Municipal Books and Records the Revenue Accounts Receivable from Various Funds Listed Resolution #272-11 Resolution Authorizing the Collector of Taxes to Rebate Payment to the Listed Taxpayer Pursuant to Final Judgment by the Essex County Board of Taxation Resolution #273-11 Resolution Authorizing Refunds -Duplicate Payment Refund(s) Ordinances on Second and Final Reading Ordinance #2331-11 On motion made by Councilman Anderton and seconded by Councilman Cirilo, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER II, SECTION 57, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE ENTITLED OPEN SPACE AND RECREATION COMMITTEE AND TRUST FUND, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard.
3 Raymond Kienzel, inquired about the above ordinance. There was no one else who wished to be heard and the public hearing was closed. On motion made by Councilman Cirilo and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. Councilman Anderton, Councilman Cirilo, Councilwoman McCartney, and Council President Spango voting “Aye”. Councilman Krakoviak voting “Nay”. Ordinance #2332-11 On motion made by Councilman Anderton and seconded by Councilwoman McCartney, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7- 32.2, RESTRICTED PARKING ZONES OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. Ordinance #2333-11 On motion made by Councilwoman McCartney and seconded by Councilman Anderton, AN ORDINANCE AUTHORIZING THE SALE OF TOWNSHIP OWNED LAND (A PORTION OF BLOCK 176.08, Lot 14) to Contiguous Property Owner Pursuant to N.J.S.A. 40A:12-13 (b)(5), was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed.
4 On motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading. All members voting “Aye”. Ordinance #2334-11 On motion made by Councilman Krakoviak and seconded by Councilman Anderton, AN ORDINANCE RELEASING, EXTINGUISHING AND VACATING THE RIGHTS OF THE PUBLIC IN A PORTION OF THE STREET KNOWN AS ARNOLD TERRACE, TOWNSHIP OF WEST ORANGE, COUNTY OF ESSEX AND STATE OF NEW JERSEY, was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed. On motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on second and final reading and ordered advertised according to law. Ordinance #2335-11 On motion made by Councilman Anderton and seconded by Councilwoman McCartney, AN ORDINANCE AUTHORIZING THE SALE OF TOWNSHIP OWNED LAND (A PORTION OF BLOCK 176.08, LOT 8 AND A PORTION OF BLOCK 176.04, LOT 15.01) TO CONTIGUOUS PROPERTY OWNER PURSUANT TO N.J.S.A 40A:12-13(B)(5), was taken up on second and final reading. All members voting “Aye”. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one who wished to be heard and the public hearing was closed.

Ordinances on First Reading Ordinance #2336-11 On motion made by Councilman Krakoviak and seconded by Councilman Cirilo, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7- 25, LOADING ZONES OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE, (16 LINDSLEY AVENUE), was taken up on first reading by title only. All members voting “Aye”. The Clerk read the ordinance by title only. On motion made by Councilwoman McCartney and seconded by Councilman Cirilo, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on December 6, 2011. Councilman Cirilo, Councilman Krakoviak, Councilwoman McCartney, and Council President Spango voting “Aye”. Councilman Anderton was not present at the time of voting. Ordinance #2337-11 On motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7- 7.3, TEMPORARY PARKING PROHIBITION FOR SNOW PLOWING AND REMOVAL, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE-FOREST AVENUE, was taken up on first reading by title only. Councilman Cirilo, Councilman Krakoviak, Councilwoman McCartney, and Council President Spango voting “Aye”. Councilman Anderton was not present at the time of voting. The Clerk read the ordinance by title only. On motion made by Councilman Cirilo and seconded by Councilman Krakoviak, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on December 6, 2011. 6 On motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7- 13, PARKING PROHIBITED AT ALL TIMES ON CERTAIN STREETS, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE, (VALLEY ROAD), was taken up on first reading by title only. All members voting “Aye”. The Clerk read the ordinance by title only. On motion made by Councilman Krakoviak and seconded by Councilman Cirilo, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on December 6, 2011. Ordinance #2340-11 On motion made by Councilman Krakoviak and seconded by Councilman Anderton, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7- 14.7, ALTERNATE SIDE PARKING, SUBSECTION 7-12, PARKING PROHIBITED FOR STREET CLEANING AND MAINTENANCE, SUBSECTION 7-7.3, TEMPORARY PARKING PROHIBITION FOR SNOW PLOWING AND REMOVAL, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE – CHARLES STREET, was taken up on first reading by title only. Ordinance #2341-11 On motion made by Councilman Krakoviak and seconded by Councilman Cirilo, AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 7, TRAFFIC, SUBSECTION 7- 141c, NIGHT PARKING RESTRICTION, OF THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF WEST ORANGE – CARTER ROAD, was taken up on first reading by title only. All members voting “Aye”. The Clerk read the ordinance by title only. On motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, the above mentioned ordinance was passed on first reading, ordered advertised according to law, to come up for second and final reading on December 6, 2011. All members voting “Aye”. Resolution #262-11 Resolution Authorizing an Award of Contract for the Construction of a New Building Entrance to the West Orange Municipal Building to R.J. Michaels & Co., Inc, 333 Dodd Street, East Orange, NJ 07017 in the Amount of $97,050.00 Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Cirilo, the above mentioned resolution was adopted. Councilman Anderton, Councilman Cirilo, Councilwoman McCartney, and Council President Spango voting “Aye”. Councilman Krakoviak voting “Nay”. Resolution #263-11 Resolution Authorizing an Award of Bid to Abbry Security Company, LLC Providing Unarmed Security Officers for West Orange Municipal Court at an Hourly Rate $12.95, Approximately $20,500 Annually Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Krakoviak, the above mentioned resolution was tabled until December 6, 2011. Councilman Anderton, Councilman Krakoviak, Councilwoman McCartney, and Council President Spango voting “Aye”. Councilman Cirilo was not present at the time of voting. Introduction of 2012 Resolution #269-11 Downtown West Orange Alliance Budget (SID)
8 Denise Esposito, Executive Director, Downtown West Orange Alliance, commented on the above budget. John McElroy, Owner of Select Towing and Board Member, Downtown West Orange Alliance commented on the video for local businesses. Following discussion and on motion made by Councilman Krakoviak and seconded by Councilwoman McCartney, the above mentioned resolution was adopted. All members voting “Aye”. Resolution #270-11 Resolution Authorizing the Implementation of a Policy for the Use of Municipal Buildings (“the Building Policy”) During Non-Business Hours and/or for Non-Essential Township Purposes Following discussion and on motion made by Councilwoman McCartney and seconded by Councilman Cirilo, the above mentioned resolution was postponed until the December 19, 2011 Council Meeting. All members voting “Aye”. The Minutes of this meeting are on file in the Office of the Municipal Clerk.
