28 (Pages 106 to 109) Page 106 1 believe we spoke about it yesterday, usage and 2 access for the clubhouse, the kennel and dog park, 3 residents only or -- 4 MR. APPEL: You're talking about the 5 clubhouse? 6 MR. CARDOZA: Well, I guess, yeah, we 7 can say the clubhouse specifically first. Residents 8 and guests or... 9 MR. APPEL: So the clubhouse is 10 typically residents or guests and what I would say, 11 this is -- this is an ownership, you know -- 12 MR. CARDOZA: Um-hum. 13 MR. APPEL: -- decision -- 14 MR. CARDOZA: Some of my questions may 15 be, a lot of them might be. 16 MR. APPEL: -- but the -- my 17 understanding is that the clubhouse is residents and 18 guests. 19 MR. CARDOZA: Okay. Taking a step 20 back looking at everything, so do we have security, 21 24/7 security on site or do we have a concierge or 22 is everything unmanned and just... 23 MR. APPEL: So we -- right now, that, 24 again, is an ownership and kind of a, you know, part 25 of a sales and marketing strategy, so I don't know Page 107 1 exactly how that would be staffed. We have allowed 2 space for a concierge at Building D. 3 MR. CARDOZA: Okay. Mr. Plocker, feel 4 free to jump in. A lot of my questions might be -- 5 I'm trying to work out how -- how this is going to 6 function. 7 MR. PLOCKER: Oh, and we very much 8 appreciate the questions, please keep going. 9 MR. CARDOZA: Okay. 10 (Court reporter asks the Chairman to instruct 11 the members of the public to keep the noise down.) 12 CHAIRMAN BAGOFF: Ladies and 13 gentlemen, we ask you to be a little quieter. 14 There's going to be a record maintained here and she 15 can't hear everything. Thank you very much, we 16 appreciate that. 17 COURT REPORTER: Thank you. 18 MR. CARDOZA: Okay. I guess looking 19 at the rooftop deck on Building D. First of all, 20 the -- 21 MR. APPEL: I'm sorry, which building 22 were you -- 23 MR. CARDOZA: Building D. 24 MR. APPEL: Building D, yes. 25 MR. CARDOZA: The rooftop deck. Page 108 1 MR. APPEL: Yes. 2 MR. CARDOZA: You mentioned the 3 original intention was for the rooftop deck to only 4 be accessible to building D residents, and did you 5 mention that there was a rooftop deck for the 6 clubhouse? 7 MR. APPEL: There -- there's a lot of 8 outdoor space at the clubhouse, but that rooftop 9 deck is part of the -- that upper floor that we were 10 talking about -- 11 MR. CARDOZA: Okay. 12 MR. APPEL: -- which

EL: There -- there's a lot of 8 outdoor space at the clubhouse, but that rooftop 9 deck is part of the -- that upper floor that we were 10 talking about -- 11 MR. CARDOZA: Okay. 12 MR. APPEL: -- which was -- which was 13 right now initially planned. That's really an 14 ownership, I don't know whether that's been 15 solidified. 16 MR. CARDOZA: Okay. 17 MR. APPEL: But there's an abundance 18 of indoor and outdoor terraces and gardens and -- 19 MR. CARDOZA: Okay. But not a rooftop 20 that people could... 21 MR. APPEL: I -- 22 MR. CARDOZA: For the purposes of, you 23 know, this rooftop is for parties, celebrating, 24 gathering. 25 MR. APPEL: Correct -- Page 109 1 MR. CARDOZA: Okay. 2 MR. APPEL: -- it's intended to be 3 passive, passive space. 4 MR. CARDOZA: As far as how this is 5 separated from the individual units and divided -- 6 the space is divided, how are we dealing with light 7 and noise, you know, what rules -- are there already 8 rules proposed to put in place to, you know, quiet 9 hours so that we're not affecting the private 10 residents? 11 MR. APPEL: I would make the 12 assumption that the leases and rules of the 13 community would have limitations of the hours that 14 any of the public spaces are -- are available and 15 open. 16 MR. CARDOZA: Do you have plans for 17 specific lighting on the public sky lounge as of 18 right now? 19 MR. APPEL: There will be lighting, 20 but our intent is to keep this lighting to be low- 21 bollard type lighting so that it's not up high but 22 it's kind of illuminating the lower surfaces, so -- 23 MR. CARDOZA: And that would be set to 24 only, you know, run at certain times of day? 25 MR. APPEL: Well, normally, there
