APPEL: -- but there are so many 7 other well-defined places to be, I would think 8 there's a lot of nicer and better program spaces for 9 them to go to. 10 MR. CARDOZA: Okay. You have no plans 11 for any outdoor grills anywhere, do you? Did you 12 mark those? 13 MR. APPEL: These could be placed, 14 there could be outdoor grills. There are special 15 grills that are permitted on a, let's say on an 16 outdoor terrace, not individual but a common 17 terrace, as well as possibly at the clubhouse, there 18 may be a grilling area that's, uh, that's included 19 as well. 20 MR. CARDOZA: And it will not be sky 21 terrace in Building -- on Building D? 22 MR. APPEL: It probably wouldn't be up 23 there, it would probably be on -- the terrace 24 between the two buildings is probably the more 25 appropriate place for that -- Page 215 1 MR. They have special grills 4 that are non-flare grills that are acceptable to put 5 onto public, you know, terraces like that. 6 MR. CARDOZA: Okay. So it's something 7 you're considering or not considering? 8 MR. APPEL: I think that would be a 9 reasonable thing -- 10 MR. CARDOZA: Okay. 11 MR. APPEL: -- as a passive amenity. 12 MR. Vice- 16 Chairman Guarino. 17 VICE-CHAIRMAN GUARINO: Last question. 18 I have a quick question about the clubhouse and the 19 facilities, stuff like that. Will the clubhouse, 20 tennis courts and the pool, will it be accessible to 21 West Essex Highlands residents 1 and 2? Or it's 22 just going to be for the apartment? 23 MR. APPEL: This is just for this 24 community. 25 VICE-CHAIRMAN GUARINO: It's just for Page 216 1 the rental units. 2 MR. APPEL: Correct. 3 CHAIRMAN BAGOFF: Thank you. ANDERSON: Which area are you 16 speaking of? 17 COUNCILMAN RUTHERFORD: The sidewalk 18 exiting the community connecting with Warner. 19 MR. ANDERSON: Okay, so the sidewalk 20 follows the slope of the road, which is permitted by 21 ADA. When you get to the intersections, the profile 22 of the road levels out to 1 percent and you have 23 crosswalks at that intersection that are compliant 24 with ADA standards. 25 COUNCILMAN RUTHERFORD: I'm very Page 217 1 satisfied with that answer, thank you. I would like 2 to -- are you the proper person -- I should have 3 probably asked this yesterday. Have you 4 incorporated any bioswales or rain gardens into your 5 stormwater management on site? 6 MR. ANDERSON: No, those are usually 7 for smaller -- smaller applications and green 8 technology. So we have green technology is the 9 porous pavement, small-scale infiltration basins and 10 so forth. So those are mechanisms which are used 11 for a little bit larger-sized storm drainage 12 systems. 13 MR. CARDOZA: Into the mic. 14 COUNCILMAN RUTHERFORD: Thank you very 15 much, Mr. Anderson. Thank you, Mr. Chair. 16 CHAIRMAN BAGOFF: Thank you. I have 17 one other thing to throw out there. I'd like the 18 builder to consider this for next time. There will 19 be a next time; I'll tell you about that in a 20 minute. This application has a lot of parking, a 21 lot of people, and we've had other projects do this, 22 that after the project is 30 percent filled, the 23 applicant will provide a jitney to the local bus 24 station and train station in perpetuity, depending 25 on how many people are using it in their complex,
